My phone call with the FDA today

I posted this elsewhere on ECF but.........

I thought everyone here may like to hear this.
Today, I phoned the MD office of the FDA. I was put through to the tobacco section via this number-800-216-7331
I informed the representative in that department that I was writing an article for my website regarding pending regulations on e cigs.

To my surprise, I was informed that the FDA do not regulate e cigs and there is no such pending determination OR regulations.
The lady was quite adamant.

I informed her that there are numerous media and general websites suggesting the FDA will rule on e cigs.
She told me that that is all false.

I'm just not sure how to take this now.
Is my government lying to me!?

No, this is NOT a prank.

Lol. While I can understand the government not being truthful I think this is just a case of a worker bee not knowing anything except the stuff that crosses her desk. Sounds like she is just putting in her time till retirement

I think I just got stumped by what she was saying.
BUT, I'm calling again on Monday morning. I'll get a name.

Since the Supreme court judge ruled, vaping is not a drug delivery device. The FDA can't do much about it. Who knows. Vape on !

However, the First Court of Appeals D.C. (not Supreme Court) did say it could be regarded as a tobacco product due to the nicotine in it.
FDA can regulate as such.

I would agree with her being clueless.

Shake-downs don't work if they admit it's a shake-down. The threat of regulation is enough to get money flowing into Washington from both the pro and anti sides. The sooner they settle on what will or won't be done the shake-down is over and the flow becomes a trickle.

The Supreme Court has not had an e-cig case before them yet. The case referred to was appealed by the FDC at the First Appellate Level in DC which typically hears cases regarding national issues.
