Well, they actually did it. This morning the Supreme Court overruled Chevron Deference. This could breath new life into present and future vape industry lawsuits. Since 1984 the Chevron doctrine has allowed agencies like the FDA to fill in the gaps when Congress passes laws that aren't clear. From now on, courts will be able to make independent interpretations of laws, instead of automatically going along with what federal agencies say. This gives me new hope for the vape industry.

I believe that in Totality, Restricting allowed Judicial Deference to Government Agencies will have a Positive Effect. Yes there is going to be some Issues, but the Net Outcome will be less Overreach, Regulatory Yo-Yoing as majorities change, and less Partisan warfare inside agencies.

My Biggest Hope would be for Congress to View this SC Ruling as a Clear Bright Line for the need of Better Legislation. And the Importance of Updating Legislation.

One thing I did want to mention is that a Court(s) have Always had the ability to Not apply a Deference to Regulatory Agencies in the absence of Statuary Clarity. The Chevron Doctrine has always been viewed as an acceptable Legal "Option" of the court. But an Option none the less. Be it Good , Bad or Indifferent.
