Dear Indianapolis City Council Members:

I am writing you to ask that you revise Prop 18 to not include electronic cigarettes (personal vaporizers) in the ban, since electronic cigarettes do not emit smoke, they pose none of the health risks imposed by secondhand smoke.

Several organizations that oppose any usage of tobacco or nicotine have attempted to ban the use of e-cigarettes in other cities & states by inaccurately claiming that using an e-cigarette is "smoking" and inaccurately claiming that the water vapor mist emitted by e-cigarettes is “smoke.”

I am 42 years old and had been a pack-a-day smoker for over 26 years. I have tried many times to quit, both cold turkey and using pharmaceutical nicotine cessation products. I've quit for months at a time, but I always started smoking again.

In November 2010, I purchased an electronic cigarette. (Even though I was not highly motivated to quit smoking.) I have now been smoke-free for over 14 months! I found immediately that I no longer wanted to smoke traditional cigarettes and quitting traditional cigarettes was extremely easy and painless. I have converted over a dozen smokers to e-cigarettes, and all breathe better, no longer have "smoker's cough" and feel overall improved health and stamina.

E-cigarettes are easily distinguishable from traditional cigarettes, as many models do not look like traditional cigarettes. My device is silver & looks like a flashlight. There is no smoke, no ash, no embers, no offensive odor, no side stream smoke from the tip and no butts. I once tried a traditional cigarette after using the e-cigarette for a few months and it tasted especially foul - something that didn't happen when quitting with traditional methods. I cannot imagine ever enjoying the taste of smoking again as long as I have my e-cigarette. I truly believe these devices are the miracle smokers and non-smokers alike have been hoping for and millions of lives will be saved as smokers switch to this reduced harm alternative. I believe so strongly in them that it has made me an activist for the first time in my 42 years.

There is ample scientific evidence and scientific opinion, as well as the testimony of hundreds of thousands of real-world users, to support electronic cigarettes as reasonably safe and effective; and there has been no evidence showing e-cigarettes pose a public health risk for users, bystanders or youth.

Well it appears that tonight is the night! The council plans to vote on this and Councilwoman Mansfield expects to get an unamended version through. Mayor Ballard has said he will veto without Councilman Vaughn's amendment which removes e-cigs from the mix as well as letting private clubs do as they see fit. Keeping my fingers crossed. I sent email messgaes to all of the members plus Mayor Ballard and Mr. Vaughn got back to me the same night. He said he was actively working on this amendment and also understood our position. Going to be an interesting few days. Brew

Indianapolis Marion County Council Members,

Please remove electronic cigarettes (e-cigarettes) from the proposed smokefree workplace ordinance since e-cigarettes emit NO smoke and pose no harm to nonusers, and because more than a million smokers have quit smoking and/or significantly reduced cigarette consumption by switching to these far less hazardous smokefree alternatives.

Since the proposed smokefree ordinance would ban smoking in just several hundred workplaces (primarily bars) in Marion County (that currently allow smoking), but would ban e-cigarette use in hundreds of thousands of workplaces, the proposed ordinance could do more harm than good for public health unless e-cigarette use is removed from the definition of "smoking".

Besides, it is insincere to falsely define "smoking" as including the use of smokefree e-cigarettes, but that's what the proposed ordinance does.

As one who has campaigned to ban smoking in workplaces for the past 25 years, I've also been urging smokers to switch to e-cigarettes and/or other smokefree tobacco/nicotine products since they are far less hazardous than cigarettes and because they pose no health risks to nonusers (unlike cigarettes). Although some anti tobacco extremists want to ban the use of all tobacco/nicotine products, that is an entirely different matter than banning indoor smoking.

In 2006, I coauthored a comprehensive scientific report "Tobacco harm reduction: an alternative cessation strategy for inveterate smokers" at HRJ | Full text | Tobacco harm reduction: an alternative cessation strategy for inveterate smokers and in 2007 the Royal College of Physicians
issued a similar report "Harm reduction in nicotine addiction; Helping people who can't quit" at

Smokers who switch to smokefree tobacco/nicotine products reduce their health risks nearly as much as smokers who quit all tobacco/nicotine usage, and several million smokers in the US have already switched to smokeless tobacco products, e-cigarettes and/or NRT products.

A recent e-cigarette clinical trial on smokers at CASAA.org found that 22.5% of participants remained smokefree after 24 weeks and another 32.5% of participants reduced daily cigarette consumption by 50%, including 12.5% who reduced daily cigarette consumption by 80%.

Former FDA Commissioner David Kessler has also acknowledged the benefits of smokeless tobacco, dissolvables and e-cigarettes as less hazardous alternatives for cigarette smokers at http://www.westport-news.com/busine...-Commissioner-talks-about-tobacco-1735433.php by stating "there's no doubt that in terms of risk of death there are some advantages to that substitution."

Other public health organizations that have extensively studied e-cigarettes have also endorsed their use by smokers, including The American Association of Public Health Physicians Regulations.gov and the American Council on Science and Health NEJM editorial: e-cigarette users should resume smoking for their own good > Facts & Fears > ACSH.

In sharp contrast to indoor smokefree policies/laws (which are largely self enforced because of broad public support), please note that it is also impossible to enforce an e-cigarette usage ban (since the products can be used discreetly without anyone else knowing). By simply waiting two seconds before exhaling, no visible vapor is exhaled by e-cigarette users, and as such, nobody will know that anyone is even using an e-cigarette. Enacting unwarranted and unenforceable regulations also would reduce the public credibility of the Indianopolis Marion County Council.

Once again, please remove the use of e-cigarettes from the proposed ordinance's definition of "smoking", and then enact the smokefree ordinance.

I knocked off a quick one...

Please do not include electronic cigarettes (which produce no smoke whatsoever) in your no-smoking ban. Doing so will only discourage people from trying a product which very well may save their lives, and there is no realistic justification for it. The only arguments against electronic cigarettes are essentially propaganda and a bunch of “maybes” and “what ifs” manufactured by people who have an agenda. Even if that agenda is good-hearted, it can only be misguided, since all of the real scientific evidence continues to show that there is nothing to be afraid of here.

I am an electronic cigarette user. I have heard that the sponsor of this bill believes that all of the emails and letters you are receiving from us electronic cigarette users are actually coming from the electronic cigarette vendors. That is simply not true. My only agenda is to help save the lives of those who are trapped in the endless cycle of expensive and nearly useless pharmaceutical smoking cessation products. I have absolutely no affiliation with anybody that sells any kind of electronic cigarette products, and I assure you that 90% of the correspondence you are receiving is from people just like me.

Anyway, thanks for your time...
