Can we actually pull another win out of our hats?
In New York no less?

I'm ready to give it a shot.

Let's hope so. I'm a New Yorker as well, and so far, I've managed to get away with vaping in my favorite clubs and restaurants - a nice change of pace, as I've become a customer again at a number of places that I dropped entirely when the smoking ban went into effect years ago.

I am not sure if I am being a buzzkill here .. but, people .. its New York.

New York government ALWAYS gets what it wants.
They ALWAYS know whats best.

Unless the Republicans, who typically are for less interference in a persons life and less government overreach, really give a hoot about this bill, its all over for sales in New York.

It just occurred to me that a good plan of attack might be to convert politicians over to vaping.

If we could make an appointment with each politician that smokes, under the guise of discussing the issue with them...
And then bring them an Ego starter kit with a couple sample bottles of juice...

Then we would have insiders, hopefully passionate, and in a position to lobby their fellow colleagues.

Too bad there isn't a master list of all smokers.

I think some of them use the e-cig. Most of them know it's much safer than smoking, but will still do the bidding of those that give them lobby and campaign money. Washington is so corrupted that the regular person would feel filthy just knowing what goes on. Really, we need an e-cig lobbyist to play the game like it's played, and millions of dollars, which we don't have. I'd make monthly donations to such an organized lobbying firm, and I bet e-cig businesses would donate what they could. Does CASAA lobby? We also need to educate the public before the spin doctors get to them. We need TV ads, etc.

I don't have the link to it but there was a health committee hearing on ecigs last year......there was video on it that i watched way back when on my computer :) but zambucalu (from ECF i think i got her name right? ) and yvilla were there and showed the health committee ecigs. I imagine if you do a search on it you'd be able to see the same info I did......I believe it was held sometime in september but it may have been august...or the other side.. october....not 100% sure......but I know it was there lol

That's great, I didn't see anything on their website about lobbying. I'll verify it and start making a monthly donation as well as solicite others to do like wise. Thanks!

Good news for New York! See this thread about Senator Owen Johnson's newly presented bill that prohibits sales to minors:

This new competing bill is VERY good news for New York. It certainly does trump Rosenthal's evil and misguided attempt at an all out sales ban. Here it is: S2926-2011 - NY Senate Open Legislation - Prohibits the sale of electronic cigarettes to minors - New York State Senate

Johnson also sponsored a similar bill last year, that only prohibited sales to minors. He had no co-sponsors, and it got nowhere, although in our lobbying to the Senate Health Committee last year we asked them to EITHER remove section two from Rosenthal and Klein's bills, OR to support Johnson's bill.

The excellent news now is that Johnson has several co-sponsors this year. We need to support it, and again urge Senators to either vote and push for this one, or at least to amend Section 2 out of Rosenthal and Klein's bill.

We also need to find an Assembly member or members who will introduce an identical bill in the Assembly, so it can triumph over Rosenthal's bill there.

Wow this is very good news! Makes me want to vote for DeFrancisco all over again! My local Assemblyman, who is Freshman Republican Donald Miller has stonewalled me in setting up a face to face meeting and really hasn't engaged in any worthwhile dialog. He has sent me two canned response written letters with no substance. This surprised me since we have kids in the same school, live in subdivisions 1/2 mile apart, are both Republicans and I voted for him! I am going to use the DeFrancisco "card" to try to make him see the light. DeFrancisco is somewhat revered here and I can't believe it would be a wise career move to pull in the opposite direction from him as a first-term Assemblyman.

I need a one page handout for my attention deficit disorder state reps. I have an appointment with Marcellino, my state senator for next Friday. Still waiting for an appointment with my state assemblyman, which I WILL get.

Now... I need a one pager that they can read, because I know they won't read a pile of documents. I plan to show them my E-Cig stuff, and I think I know what to say, but I need a one page document that uses as many "recognized" acedemics and other such reputable and credible sources to drive our message home.

Do we as a group have such a one pager? Something that references studies and other hard data to drive the point home to people that have short attention spans? Something to make a stone think? Unless it's short and to the point, it won't get read. I can always offer more documentation later if the fishes take the hook.

Think of it this way. Let's say I can these two legislators think... and they want to tell other legislators. They aren't going to forward a huge PDF, but a one page document? One they could hand out or forward? And then be ready to follow that up with more supporting documentation?

To further the one page idea, I am willing to go to Albany and do handouts as the legislators go to session. One page. It has to be one page. Is there a one pager that can deliver the message?

I want to get active on this, but going solo is not likely to work. I need help with tools... like a one pager.

Is it possible to do handouts as they go in?? Or do they go in via a backdoor? If it is possible to do this, I am very willing to help you. I work right down the road from the capital and can be there within minutes. I can also print out the copies needed.

To be honest the one page header letter idea isnt to bad at all. But not just for the fat cats in government. I wouldnt mind having something like that to pass out from my work as well as give to a few local paper boys to toss about on there routes.

Get the word out there to the people as well as the politicians.

DC2, you did not see my post right under NoMatches' original request for a one-pager?

The Position Statement I linked to is an existing, excellent one-pager, with citations to some of the more important references, including the Siegel journal article, and packs a ton of good information into its bulleted lists, etc.

I say bring them e-cigars. Don't they all like to sit around feeling important sucking on big expensive cigars. Of course, you may have to lie and tell them the e-cigars cost a lot of money otherwise they will never go for it.

Guys im in Australia and worried something like this will happen here soon. Is it possible legally if something like this was to pass that a class action law suit be taken out against the departments behind this ban.

If the product is banned due to recent research they are knowingly sending smokers back to a product they know is killing them. If hundreds of people are sending in letters contacting these committee members then there are also hundreds of people that can be used in a class action suit.

With all the legal action taken against tobacco companies for killing people why would it not be possible to sue someone for sending people back to a product that data shows will kill people. What are they going to use to defend it research that the fda has did. The claims are obviously flawed if they wont release the data it contained.

I would seriously consider using a tactic like this if its going to work it will work in the USA.

My wife is not a practicing lawyer, but she did pass the bar, so take it with a grain of salt...

She says there can be no lawsuit unless someone were to show damages.
And then they would have to be able to prove that the damage was directly caused by smoking cigarettes.
And then they would have to be able to prove that electronic cigarette use would have prevented that damage.

And even then, they would argue that no one MADE you go back to smoking cigarettes.
So in the end, they would not be liable for any such damages.

But keep in mind my wife NEVER thinks anybody can be sued whenever I ask her about it.

I got this response from Assemblyman Ed Ra:

Thanks for your email urging me to oppose A. 1468/S. 695, which would ban the sale of electronic cigarettes to adults until the Food & Drug Administration ("FDA") approves them for sale as a tobacco use cessation or harm reduction product. I have received many emails similar to your own, expressing the view that: electronic cigarettes are a safer alternative and an effective substitute for tobacco cigarettes.

As you may know, this legislation is currently in the Assembly Codes Committee. I will keep your concerns in mind as I continue to review it.
