Fortunately, in the commoditized tort system which is US civil justice, there is an excellent remedy for the problem of disinformation campaigns. Let's suppose that Ohio bans retail e-cig sales in 2011. In 2016, 30 year old Ms. Smith dies of lung cancer. Lawyer Jones meets with the Smith family to go over estate matters, and one of the Smiths tells Jones about how five years ago the late Ms. Smith quit tobacco for a month by using e-cigs, but then they were banned. Jones goes back to his office and googles this and gathers 10 years of data from prohibition jurisdictions and from harm-reduction (pro-ecig) jurisdictions like England. The dollar signs literally light up in Jones' eyes and he gets a Woodrow that will not quit until he has recovered each and every dollar available from the Ohio treasury for his class action clients.
This will happen; this is the way things work, it just may take a while and way too many Ms. Smiths will die first.

Well, tats a good story. How abt if one of the Governments who family member is a Smoker, well that smoker wanted to use e-Cig to quit smoking but due to his family members dis-approved E-Cig and when he die, the government finally realized that he is wrong the whole time about e-Cig.
