I don't think extending the PMTA deadline will help the b&m vape shops as much as it would under other circumstances. Many are closed and I expect most are losing money at this point, yet when businesses start re-opening foot traffic will be much lower than previously for some time. It could take months to become profitable, all under the cloud of the FDA and bans. Better to have only an internet storefront at this point - the virus may have bought you some quality time!
Not sure. Internet presence makes a business easy for the FDA to find, while a local B&M that keeps a low profile might be able to fly under the radar for a long time, especially if they're located in a jurisdiction that isn't keen on nannystateism.

If stockpiling consumables wasn't practical, the place I would be looking to buy them is a local smoke/vape shop. I bet many of them will keep vape goods "under the counter" for their regular, known customers, and they have an alibi to remain open. Some vape shops seem to be pursing a parallel path, branching out into CBD and similar products. My guess is many of them will also continue to have nicotine products available for people they know aren't narcs.

That's like back in the day when we had those small, independent "corner stores". Basically they were tiny little conveniences stores in residential neighborhoods where kids would buy "penny candy" and they sold a small amount of dry groceries, drinks, milk, cigarettes, chew and probably lottery tickets.

Anyhow, there were a couple of these places I knew of that sold illegal fireworks as Independence Day was approaching. But you could not just go in and ask for some firecrackers, bottle rockets, roman candles lol. They were only sold to those customers they were comfortable with over the years. I never was able to buy them because I wasn't on the "preferred customer" list lol, but I knew dudes who could and would resell them to me. :) Lots of people knew they sold them, but few could actually buy them.

So am I understanding correctly, that deeming has now been postponed until September?

E-Cigarette Deadline Extended Amid COVID-19 Pandemic - Law360

So I was doing a little looking around and it appears that the extension is not a reality yet, as I suspected. Swisher international posted a notice about it 7 days ago because another site (a convenience store trade organization) was also making it seem like the extension was a reality, when in fact it's not.

"Today, a convenience store trade publication published an article that reported the FDA’s May 12, 2020 filing deadline for pre-market tobacco applications has been extended 120 days by Federal District Court Judge Paul Grimm. However, while Judge Grimm issued an “indicative order” indicating that he agrees with the FDA’s request for the 120-day extension, the U.S. Circuit Court of Appeals for the Fourth Circuit must also issue an order allowing Judge Grimm to modify the original order that he issued which set the filing deadline as May 12, 2020. The U.S. Circuit Court of Appeals has not yet issued that order because the court was allowing the health organization plaintiffs in the underlying litigation until today to file responses to the FDA’s extension request. Until the U.S. Circuit Court of Appeals receives any responses from the plaintiffs and issues an order allowing Judge Grimm to proceed with extending the filing deadline date, the filing deadline remains as May 12, 2020."

That convenience store trade publication is CStore Decisions and they have since taken the article down.

CBD shops are proliferating like rabbits down here, it reminds me of video rentals shops a few years back. And most are doing as you suggest, selling vape products without advertising the fact.

From what I have heard and from my tiny bit if "research" into the matter (because it really doesn't apply to me at this juncture), it appears that 99.99% of vape companies that we know of have not even submitted any PMTAs anyway.

I guess they are perfectly fine with either going out of business or, in the case of overseas suppliers, they are fine not selling to the USA?

you can search fda registered establishments and products Establishment Registration & Tobacco Product Listing

our government (australia) seem to want to use this time with everyone distracted by cooties to close loopholes that leave customs letting nicotine into the country
