TX Vapers - Have you heard anything about this?

Man it's a brutal law. I mostly skimmed it but it makes it criminal to sell to anyone under 18 as well as forcing retailers to card anyone under 27....yes it does. It also regulates packaging of eliquid including child resistance caps and age verification demands for online purchases...wow. It also equates eliquid to tobacco including 0nic eliquid. It makes no differentiation between tobacco and eliquid. What a terrible read. All sellers of eliquid must sign a form acknowledging these new laws before they engage in a retail business selling eliquid.

They still card my wife for alcohol at age 50 even when our 17 year old daughter is with her. She likes seeing their expression when they figure out she is 50. Age limits were going to happen no matter what.

I've read the full text of the entire law.

99% of the law I have no problems with. 99% of the law is exclusive to sales and distribution to a minor, possession and use by a minor, and use on school property, and would have no effect on adult purchasing, use, or possession.\

However, there are three specific parts that concern me enough to point them out. While I don't necessarily disagree with the first, I feel it should be specifically pointed out so that my fellow Texans who read this are aware of it.


#1. Vaping in a car with a child who is required to be in a car seat is a Class C Misdemeanor. You will be fined and required to take a state approved parenting class. This wouldn't effect me personally as my daughter is 13, but everyone here should be aware of it. Even out of state visitors should know this law as they are not exempt from it.

#2. ALL egic liquids including 0 Nicotine juice as well as ecig hardware is illegal to sell to OR GIVE TO a minor. This applies to parents as well. In otherwords, if you catch your lovely child smoking and think giving them an ecig as an alternative instead is a good option, think again. As with #1, this is a Class C Misdemeanor and if you are the parent you will not only be fined but required to take a state approved parenting class as well.

#3. This law classifies ecig liquids, even 0 Nic liquids as tobacco products and EFFECTIVE IMMEDIATELY adds vaping to any and all smoking prohibitions in public places. So if you're one of those people who think you have the right to vape in a store, mall, at your work, or anywhere else where smoking is banned you had better think again. You can and likely will be fined by the police the same as if you were smoking. This actually has a direct effect on me as I am currently allowed to vape in my office by my boss, but smoking is banned in the building. If anyone were to complain I could be fined, not to mention my employer could be in a lot of trouble with building management, possibly effecting my employment despite the fact that my boss currently allows it.
