Copy of email sent to my Delaware State Representative regarding hearings on HB 309.
My State Rep responded quickly to my email.

Dr. Richard Carmona, the 17th U.S. Surgeon General said the devices have become a source of debate in public health care.
"I understand the struggle of people trying to fit it into a complex society. ‘It looks like a cigarette, so why don't we just regulate like a cigarette?'" he said. "But then there's the negative consequences."

The consequence of banning e-cigarettes in public spaces, he said, is that people no longer have access to something that reduces their tobacco use.

"I'd rather have to worry about getting people off of or withdrawing from nicotine in e-cigarettes than having them continue to smoke tobacco, which is combustible, which causes cancer and a whole host of diseases," he said.

Thank you for listening to my advocacy as well as a US Surgeon Generals for fair treatment
of tobacco free solutions in public spaces. Allowing use of theses alternative devices will benefit the public by encouraging the use of non smoking alternatives.

I will certainly address the timeliness of this public notice.
I have heard of the meeting and believe I saw a conflict in my schedule, however, I will check when in the office today.
I'm aware of the sponsors and will learn of other key legislators involved with this bill to forward your excellent piece of intelligence on the matter.

I also emailed all elected officials in the Call to Action plus the three co-sponsors of the bill the morning of the scheduled hearing. I have not received any response at all from any of them. I'm glad to hear there was such a huge response from Delaware vapers!!! Hopefully, it will have some bearing on the outcome.

There is a growing groundswell to encourage vapeing on the beaches and boardwalks that have already banned smoking in Delaware.
Enforcement will have interesting consequence. Should be an interesting summer in Rehoboth and Dewey.
How can a non nicotine mixture be cited as a nicotine delivery system. Some vapers just vape zero mg nicotine .

If they pass a law against nic delivery systems, get 1000 vapers together and all vape 0 nic. I'd love to see the cost of testing 1000 liquids for nicotine.

Here is the latest from the CASAA call to action:

UPDATE 5/4/14: As of midnight May 3, 2014, HB 309 has not been placed on the agenda for the House Health and Human Development Committee's May 7, 2014 meeting. It is possible (if not likely) that HB 309 will, once again, be set for hearing with little or no advance notice, so vapers and harm reduction advocates are encouraged to continue to call and email members of the Committee and make arrangements to keep WEDNESDAY, May 7th, 2014 available to attend a hearing should one be scheduled.

We will continue to update this Call to Action when more information becomes available.


They are gonna try to slip this in under our noses again, Ive been to enough 2A rallies in this state to know the only thing that the legislators in Delaware understand is a big show of force and unity. Lets make sure we are all there to let them know we arent going to allow this when they try to sneak it through again.

Your response is welcomed and appreciated.
A few points however come to mind.


If sale or possession of eCigs to minors were made illegal then the drug use you mentioned would be avoidable and contained. A minor who brandished these eCigs would by definition be doing an illegal act and the unit would be confiscated. The material being ingested would be not an issue since the device itself would warrant confiscation.
Ban the use and possession by minors and the rest of the population who legally choose non tobacco delivery devices would be appreciative.
Again, a noted Heath Care Medical professional in the person of the 17th US Surgeon General advocates the promotion of non tobacco delivery devices.
Follow his lead into a heath conscious solution to encourage the use of non tobacco delivery devises in all practical public spaces.
Thanks for hearing my point of view and for your representation on our behalf.

{OTHER STUFF} oils are often used in the devices as well. The e-cigarettes themselves should not be restricted as much as a tobacco smoke product, but the contents of the e-cigarette should be as it is now- if it's a controlled substance and you have no authority to possess it, then the possession of the illegal substance should be addressed making the e-cigarettes become a paraphernalia for ingestion.

So, have they banned bake sales? Cookies? Brownies? Homemade lunches? Not just at school, but statewide? For adults? No more church potlucks? No more stores selling Mrs. Fields because kids could make counterfeit Mrs. Fields and bring them to school?

There is NOTHING new about kids being able to bring bad things to school undetectably. All that is new is that the media is acting like all this is new. Nicotine poisonings are not new, ecigs are simply replacing the calls that used to be for cigarettes and NRT. Kid sneaking things into school undetectably is not new. Selling adult beverages with flavors is not new. ALL that is new here is the huge profit loss of Big Tobacco and Big Pharma. And all these bans actually benefit Big Tobacco more than Big Pharma, but BT knows they cannot lobby because they are unpopular, so they stand back and let BP hand us back to BT.

Funny thing is...water containers, juice bottles etc could contain booze.
Do we rail against kids in school using these 'suspicious ' paraphernalia devices? (Sarcastic tone hopefully obvious).
God save us from being led by the stupid among us. Elect only the 'intelligent' among us.

But you can smell alcohol and smoke (of either variety) on peoples' breath, making it more detectable.

here in minnesota a lot of schools have banned bake sales.i don't think by force of law though.
a lot of other places normally associated with bake sales have stopped doing them due to liability issues.
