Cruel and Unusual Punishment - Please help Utah Vapers fight against bullying bureaucrats

CALL TO ACTION: Bountiful Utah revokes 4 B&M business licenses.
On December 26th, four vape shops in Bountiful Utah (Vapor R Us, Urban Vapor, Vapor Dreams & VaporLoc) received notice from the city that their stores were in violation of the state zoning ordinances and that they must shut down their business on New Year's Eve.

We need all vapers to help fight this and demonstrate to the city and to Utah that their mistake has grave consequences on REAL people. We will need people to send emails, make phone calls and where possible to also donate to the legal defense fund. For details on how you can assist, please visit this link.

Finally, a local ecig problem where non-locals can help. I’m donating, emailing and making calls. Closing down these stores is totally unacceptable.:mad:

We can all help in other battles, as a Tourist, Business Person, Visitor to that town. We don't have to be a resident to help.

Thanks Lisa for posting this - I've been too busy to hit every social media platform out there. We really do need everyone to help out in some way. We WANT their email system to crash due to the large number of emails. We WANT their switchboard operator to want to know why she's getting hundreds of calls. This battle is totally being fought in the media and across the community since the city office gave them 2 business days to fight it. They brought the fight to OUR door. Now we have a kick ... attorney, we have the Utah public (darn near the ENTIRE Utah public) on our side. I'm bringing this fight to THEIR door and they will realize that the vaping community is not a small community that can be walked all over. WE ARE VAPERS!

FYI: I emailed 3 members of the Bountiful City Council earlier today, telling them (mostly courteously) what I thought of their actions. Just received a reply from John Knight. He says he found out about this only Thursday night (26th), he plans to speak to City staff tomorrow (Monday) to see if they can "find a more sensible solution amenable to all." He ends by saying he doesn't "have a darned thing against e-cigarettes."

We shall see...

This just in: Bountiful e-cigarette businesses allowed to stay open in 2014 | FOX13Now.com

The article states

On Monday, city leaders sent a letter to the business owners saying they can continue their operations in their current locations during 2014. They said the city will not prosecute or seek to close the businesses based on the location violation.

The letter said the businesses should not expect to be issued a license in their current location in 2015.

At least they are being given a one-year grace period to find new locations (if that's possible).

No strip clubs, liquor stores, smoke shops, head shops, payday loans, sex shops or vape shops allowed around schools, parks or churches. Makes me want to start a church that worships strippers by getting small loans through the priest to buy booze, tobacco, vape gear and dildos as offerings.

Thank you in advance for taking the time to read this.

I was a cigarette smoker for approximately forty years. I tried every imaginable method to kick the habit. Nicotine patches were either ineffective, or gave me horrible nightmares when worn overnight. Nicotine gum was either too weak to be effective, or so strong it caused nausea. Nicotine lozenges had the same affect as the gum. Wellbutrin made me borderline suicidal. Cold turkey cost me a marriage.

The only thing that has allowed me to both stop the cigarettes and maintain a semblance of normalcy has been vaping, or as many call it the use of "e-cigarettes." I started in August of this year, and haven't felt the need to purchase a tobacco cigarette since, nor have I done so. I have systematically been reducing my nicotine intake with very little discomfort. I am now vaping liquids with my nicotine intake one-quarter of what it was on the tobacco cigarettes.

My doctor has noticed and commented on the improvement in my health during this time. My lung function is much, much better, blood pressure lower, and I have gotten to the point where I can run a mile in eight minutes or less, something I've been unable to do in over twenty years.

There are multiple studies that have shown that nicotine in and of itself is about as harmful and addictive as caffeine. Anyone who eats tomatoes, potatoes or eggplant is consuming nicotine.

It has come to my attention that vapor (or 'e-cigarette') shops in your jurisdiction have been singled out to have their business licenses revoked, and on extremely short notice.

There are several factors which combine to make this a poor policy decision.

Jobs. Is it really a wise decision in the current business climate to take actions that close businesses and cost people their jobs? While I'm sure it's not a large number of voters, I'm sure that they will not appreciate their jobs being taken away, and vote accordingly.

Health. While it's very popular to say, "we just don't know enough about them," that statement in and of itself should be enough to make one take pause prior to enacting legislation to discourage the behavior. My own physician has recognized and commented on the positive effects of vaping versus smoking. Making such devices and liquids more difficult to obtain will have the effect of keeping people on tobacco cigarettes. Is keeping people on cigarettes really a cause anyone wants to be aligned with?

Consistency. Trust. What of the people who did their due diligence prior to either going deeply in debt or sinking their life savings into a business? Too bad, so sad? They were told that there would be no issue, and now the rug is being yanked from beneath them? Do you really want to be seen as indifferent to small businesses, the backbone of our country? These are the same people who already have the type of drive it takes and are being supplied the motivation to campaign either for or against someone in coming elections. Which way do you wish to nudge them?

Please reconsider this action. It would be great to see you come out on the side of jobs, health and justice.

Oh, and FWIW, the LDS in my screen name has nothing to do with any church, it's short for Low Down Sinner as a matter of fact. :D

Emails in situations like this are *never* a waste of time! If nothing else, we go on record as being aware of these tactics and put these people on notice that we are vocal and we are paying attention. Remember, vapers are voters!

Thanks for the thoughts. I just meant that I sent my emails after they had decided to give the B&Ms another year. I don't know what went on politically in Utah, but it could be interesting to hear about.

IMHO, the emails and calls DID help letting them know there was not going to be a "lay down and play dead" and they better stop and think this through. I imagine it made them think about law suits and that they would be responsible for 100% of the business' losses due to essentially no notification of their rezoning. It could even go into damages other than just business losses if there were other impacts as a result of sudden loss of income to the business owner's family or just themselves.... so many possible damages that would all come from suddenly loosing income. Anyway, those business losses or damages suits would be easily provable in court due to the sudden closures. Nanny staters tend to be highly emotional and don't do much logical thinking before they act and the general nationwide political landscape makes them feel like demigods. As I said, this is just my personal opinion.

Folks this is not over. This is being appealed following normal processes as the city's proposal is unacceptable due to them requiring the shops to operate without a business license putting them at higher risk. We have the attorney addressing this very seriously and the shops are fighting this quite hard.

THAT one needs to be fought in the press. Until this hit the media, I bet folks in Utah were mostly ignoring Ray's bills figuring it didn't affect them. But messing with small businesses affects them. Time to lobby the LDS elders, too, on the benefits to the body of QUITTING SMOKING.
