Zenfrogs, changing the law to include e cigs would require an amendment to the law being passed by the General Assembly and signed by the Governor. Since the Republican-controlled House would only pass the original smoking ban if there were exemptions, including smoking rooms, my personal opinion is that it is highly unlikely they would support banning e cigs that produce no smoke. I also highly doubt the new Republican Govenor, who was against the smoking ban when he was AG, would sign any such amendment. That does not mean the anti-smoker zealots won't try...providing the FDA doesn't succeed in their court case and manage to make all this moot, anyway.

The idiocy of the American Cancer Society's quote lays bare their lack of credibility, doesn't it? The FDA is probably freaking out, too. Not to mention ASH who did, indeed, send letters to 49 AGs asking them to ban e cigs (the other AG had already done so). Of course, ASH sent that letter before the November election and therefore prior to Mr. Cuccinelli taking over that office.

We should also thank Delegate Peace for asking for this ruling and coming down on the side of common sense.

that's what I was thinking would have to happen... thanks for the confirmation. I am curious to see how the VDH will handle this over the next few days/weeks. I still wouldn't try to vape in a restaurant,etc. I am also curious to see how much press this gets around the state over the next few days and what the general reaction will be. If it gets no media attention and the VDH doesn't inform businesses (and I don't think they would) I imagine it will have very little impact initially and establishments will not welcome vaping for fear of fines and because they are unaware the ATG's statement.

awesome job in Virginia. Thing is, restaurants can still refuse service or tell you to put it away etc. and I can see that happening. PLaces with bars may actually promote them and be vapor friendly, others will freak out on you. I may have to carry the new DH guidance with me and a copy of the webpage. Being in Va, I am waiting to see how much of the local news picks up on this.
 
I live in Georgia. Considering how conservative this state is, I had expected a harder time with the ecig in public places. However, so far I have vaped in the emergency room at the hospital, a concert, the airport and several restaurants. I was approached only in the emergency room and once the RN heard and saw what it was, she only had one question, "where do I get one?" Great job in Virginia. I hope all other states make note.

For those of you who would like to see/print the original letter, I tried to use the web address from the AG's office and got "page not found". So, here is how you should be able to find the original letter: do a Google search for vaag.com. The Attorney General's website should come up. Once you reach the AG's home page, click on "Legal and Legislative Reference" in the lefthand column. When that page opens, click on "Official Opinions", which will take you to a page listing opinions from both this and previous years. Click on "2010", which takes you to yet another page listing the months for 2010; click on "April", and the e cig ruling is at the top of the page.

At least, I hope that works....
