If possible try to demonstrate the ecig and it's ability to make the detector think there is alcohol in your system in court. First make sure you will get 100% negative and use the device. Then do some vaping right in front of them, then blow again in the device, which should register a BAC. I think that alone could help a lot.

Too bad that wouldn't work in Arizona where vaping is actually LISTED in the things you're not allowed to drive "under the influence" of.

Yeah that is strange, what about smoking cigarettes?

I would imagine when they refer to vapor, they are probably not talking about ecigs and nicotine, but rather some 'other' stuff. Banning ecig vapor is like banning drinking coffee in your car and driving. I mean caffeine is a drug too.

You have to remember that Arizona's legislature has been overtaken by monstrous idiots and they've passed a bucketload of moral judgment laws against things they don't approve of. Talk about a nanny state!

But, we can haz our guns....lol

thanks for the advice! yea they dont have a case because they made a lot of mistakes and my bac was so low.. 0.01. i talked to the DA and a few lawyers who asked me tons of questions and they felt realy bad for me. the lawyers even said that there was definitely no case as far as the DUI goes and even suggested not hiring a lawyer for this. and these were dui lawyers saying this.

this was just a fluke because the trainee cop was just being taught how to get a car towed and how to issue a breathalyzer test in a strict fashion.

i just wanted to warn everyone because i couldnt find a thread about this and just wanted people to know.

Though the lawyers may have your best interest in mind, I would think that the DA would want as many convictions on his record as possible...

If it were me I would get a good lawyer.

We can't even legally have sparklers.

A courtroom demo of how the menthol juice interacts with the breathalyzer is spot on. Sock it to 'em!
While I love having fireworks available now (we only got them legalized like last year or so...maybe two years), we DO live in the desert and are usually in the middle of a long drought period. Wildfires and forest fires are a regular thing here.

I'm not sure it's WISE to have them so easily accessible in Arizona.

I have never heard of anyone being charged with a DUI based on the results of a hand held breathalyzer- even in California. While the device may be used to show probable cause for an arrest; a case can't be made of the results, as there is no evidence once the machine is cleared- that's why they have blood tests or stationary alco-sensors at the police station which are calibrated and give a print out of the results. There is no case as there is no evidence.

Always ask for a blood test, though. Any competent lawyer can unravel the chain of custody when blood work is involved.

We can't have them, use them, or buy them here. All we get are the crappy "safe and sane" fireworks, and only for about 7 days before the 4th of July. California is the leader nanny of all the states (except for perhaps New York state). You may think you have it bad, but just remember... California is worse.

Oh and you can legally buy switchblades there, we can only buy the box opening types (less than 2" in blade length). :p

I haven't found much need for a switchblade since I got the gun.

Besides, I have a whole cigar box full of boxcutters....hehehe

You can’t drive under the influence of vaping in AZ but you can have fireworks in dry brush. Makes sense to me. Nevada does a brisk business in fireworks. We can’t have them because of the fire hazard. Can’t even be in possession of them. Good law around here. This summer we had a human-caused 400+ square mile fire within a mile of our house.

Good idea Cmdebrecht! It really looks like he was just had because he is 19. This is not going to look good for CHP Jr. in training when all is said and done.

Exactly, I am not calling bovine scat...but I am calling bovine scat. a portable breath test is only used to provide PC to make an arrest so the suspect can be tested with a calibrated Breathalyzer (big B, it is a brand name) or via a blood draw.

sory guys, i just reaized. i dont want the tread to turn into a debate, i just want it to be informational.

I have never seen this brought up.

I have never seen this even mentioned by ANY eliquid vendor, even the ones who claim to have labs.

That's amazing. I hope it doesn't end up costing you any money, good luck
