Well, that's an interesting way to put it. IANAL, but while there is a CO law prohibiting
smoking, it doesn't address vaping at all. IIRC, LisaB vapes at a casino in Central City. And AtomPunk vapes at a bar up in Thornton. I suppose I ought to read the actual language of the law, to see whether, by the definitions used, it could be construed as including vaping. But I've explained to a few people that since there is no tobacco, no combustion, and no ash, vaping is in fact not
smoking in any way. However, I can understand if a business would want to prohibit it anyway, just because they don't want to deal with complaints. Whether the "it's not smoking" argument would hold up in court ... I'll hazard a guess that that would depend on the mindset of the judge involved.
