They talked about bringing it back on the table earlier this year and yes it did not pass, but I seriously don't doubt after August 9th there will be no taxes. ENDS and juices are going to be tobacco products so yes they will be taxed and there are going to be states that run with it as fast as they can. Look what has already happened in Cook County, IL.

I live in California. Just got an order from Mt Baker last week and nothing was different about the ordering process. I'm not sure where you heard that from, but it seems like misinformation at this point.

Then you most likely got your order in just under the cutoff. If you try to order again you will get dumped at the cart level trying to ship to a CA address.

Go read the blog at Mt. Baker. For the foreseeable future - until they figure out the requirements to comply with CA's self-imposed deeming - Mt. Baker won't be shipping to CA. California did not impose just a simple age requirement for vape products - it's a lot more complicated than that.

Until they get the software?

You'd think they would have been prepared. There are online vendors that have verification software already on their sites. MBV is going to lose alot of business if they waste anytime which makes me think they will install the software sooner than later.

I absolutely do not understand why businesses, especially ones of the stature of MBV, were not prepared with systems readied. Unless they don't plan on staying in business.

I live in NC, they Instituted a sin tax on juice with nic last year. Last check it was 5 cent per ml if it has nic in it. I DIY so not much of an issue for me. But I do support local b&m so if I like a juice there i just get 0 nic and add nic it at home.
I discovered the sin tax buying a bottle of one hit wonder juice in 180ml bottle. After I calmed down lol had them sell me 0 nic.

Especially with the fda regs. Companies that have so many flavors cannot realistically submit a pmta for each one in each nic level. It's insane. I hate the fda.

That .05/ml tax was just a way to get it passed because it comes across as reasonable and there was not much pushback. It's guaranteed to rise on a pretty regular basis. I remember having conversations with local vapers last year who only bought juice at B&Ms and had no idea about the tax. None of them had an issue with it (and probably still don't). IIRC, RJR lobbied for that tax.

While all of this is looking bad on a wide scale level for those who may want to switch from Camels to vaping in the future, I am personally not as frantic and worried now compared to what I was when the deeming regs (federal) were released. Or when I first heard about the Indiana law that will take effect in July of this year.

Fasttech or whoever isn't going to stop shipping hardware (mods, tanks, coils, ect.) to the United States, legal or not. Since when did China care about our laws? And the likelihood of a small order being seized by customs is exactly that ... Very small. With that being said, I have been stocking up on mods, tanks, and coils as of late. Some from Fasttech, some from U.S. based companies. A lot (or most) of the hardware manufacturers aren't even based in the United States, so they aren't going to stop manufacturing products, just because they can't legally sell to the U.S. any longer. They will still have a legitimate business in other markets. We will just obtain the hardware in a different way.

Illumn and other trusted suppliers are not going to stop selling us batteries.

Capella's, TPA, FA ... They are not going to stop selling us flavor extract. They were around before DIY was a thing, along with many others.

No one is going to stop selling VG or PG. That should be a given, but I'll say it anyway.

My only real concern is nicotine. I'm vaping 1.5mg now, so the liter I have should last me another 6-8 years depending on how much I vape. For the small price tag, I may buy another liter of nicotine, just to have it. Who knows if it will even be good by the time I get around to using it, but 80 some dollars is a small investment to lose, should it go bad, considering the current circumstances.

All in all, none of this is good news, but there will be work arounds until we sort through the mess. If we can't win the legal battle, I'll go underground, before I go home.

I don't see MBV submitting PTMAs to the FDA ... I see MBV's fate being the same as all juice mixers ... soon to exit the Vape Industry, gone by 2018-19.

IMO, the only juice company that might submit eLiquid for open tank Vaping is NJOY.

I don't see Five Pawns submitting PTMAs either.

If Njoy submits a PMTA and it gets accepted it is designed to be extremely difficult to bring a new product to market. There is some doubt if FDA will even allow a "new product" as it stands. All it will take is one or two PMTA's to get approved for market, then it may be possible to claim "Substantial Equivalence". The FDA will not like that at all. Seems like the FDA mission is to keep people smoking, getting sick, and to keep doctors getting rich off of insurance/ tax kickbacks. They can not keep salmonella from getting on a head of lettuce or a tomato, but they darn sure can keep the horrors of BT profitable. This is all IMHO.

    The schedule looks to me like:

    now--some issues with age verification and payment processing

    August 8, 2016--probably serious issues with age verification and payment processing begin
    --no new products
    --stock up wise, grab some basics, possible service interruption, but don't go broke and ejuice doesn't last forever.

    August 8, 2018--end of sale of products without FDA applications in
    --stock up wise, BIG deadline

    August 8, 2019--end of sale of unapproved products

    ???-- preemptive gov't action?
    ???-- we find out, will FDA approve anything. It is somewhat possible they are following the only road available to some sort of endorsement, only acting tough. It will still change the landscape, and I oppose this on the basis of freedom, vaping came from the free market and thus should stay free market. But I'm not sure enough of their guilt to call for no compromise, and I would, no taxes, no age restrictions, no limitations of any kind should be accepted if they are found acting in as bad of faith as it appears.
