F.D.A. Authorizes E-Cigarettes to Stay on U.S. Market for the First Time
The agency approved three Vuse vaping products and said their benefits in helping smokers quit outweighed the risks of hooking youths.

"The Food and Drug Administration for the first time on Tuesday authorized an electronic cigarette to be sold in the United States, a significant turn in one of the most contentious public health debates in decades.

In greenlighting a device and tobacco-flavored cartridges marketed by R.J. Reynolds under the brand name Vuse, the agency signaled that it believed that the help certain vaping devices offer smokers to quit traditional cigarettes is more significant than the risks of ensnaring a new generation.

“The authorized products’ aerosols are significantly less toxic than combusted cigarettes based on available data,” the F.D.A. said in a statement announcing the decision.

The statement concluded, “The F.D.A. determined that the potential benefit to smokers who switch completely or significantly reduce their cigarette use, would outweigh the risk to youth.”

The watershed decision could pave the way for authorization of some other electronic cigarettes, including those of the once-dominant maker Juul, to stay on the market. For more than a year, the manufacturers of e-cigarettes have been in a holding pattern — most of their products on the market but awaiting official authorization — as the F.D.A. has investigated whether they were a benefit or a danger to public health........."

Who didn't suspect that the bad press of the original e cigs weren't geared toward big companies grabbling the market?
BUT - Don't dismiss the significance of the FDA admitting that YES e-cigarettes are safer than lit cigarettes:

"“The authorized products’ aerosols are significantly less toxic than combusted cigarettes based on available data,”

Let that sink in for awhile - 'cause had they not made that ruling there was a good chance that they might have outlawed the entire industry and we would have had full scale vape prohibition.

And with that ruling in place - the other rulings against the other and smaller companies including those making flavors have a better chance of winning in pending lawsuits against the FDA.

Let's Wait and See how many Non-BT products get an Authorization from this FDA before talk'n about being significant.

And if these "Aerosols" are so Significantly Less Toxic than Cigarette Smoke, why is 99.6% of the Market seemingly destine for the Dust Bin?

JSYK...

That NYT Article is behind a Log-In Wall.
Then try this one:

U.S. FDA gives marketing nod to an e-cigarette for the first time

"Oct 12 (Reuters) - The U.S. Food and Drug Administration (FDA) on Tuesday allowed British American Tobacco Plc (BAT) (BATS.L) to market its Vuse Solo e-cigarettes and tobacco-flavored pods, making it the first-ever vapor product to get clearance from the health regulator.

The FDA said the approval came after analysis of data from the manufacturer that showed that using Vuse's tobacco-flavored products could help users reduce exposure to harmful chemicals emitted by combustible cigarettes......"

"It's not over 'till its over" - Small manufactures now have a stronger case to overturn previous FDA rulings against them. - Do you really think the FDA's contention that flavors are more appealing to minors is going to stand up in court ? - Especially since all vape products are specifically outlawed for everyone under 21.

With the level of Judicial Deference afforded to the FDA, I Don't think a "Flavor" Lawsuit claiming that Flavors should be allowed can withstand the Federal Court System.

This whole thing just reeks of crony capitalism.
First they take out all the mom and pop companies who can’t pay the large fees for product testing, while at the same time the news media run rampant with health concerns. Then once that’s all finished they start approving big tobacco company products and even seem to endorse their health benefits.

Sure that's true.
But I don't care what anyone says - I still say that getting them to admit, and I believe that it is for the first time, that vaping is safer {less toxic} than lit tobacco is a major achievement - All the little guys {mom and pop companies} now have a leg to stand on in the coming lawsuits challenging the FDA which are already starting.
I believe some mom and pop companies will survive and at least some of their products will be approved.

And think about flavored vape juice bans for a minute.
Obesity is a leading health hazard mostly caused by overeating - If the logic that the FDA is using to ban flavors were followed, then next they should start banning spices because they make food taste too good and cause obesity - especially dangerous to kids and teenagers who will develop a pattern of overeating that will lead to obesity in life and a shorter life span - So they should begin by outlawing all hot dogs, meatball heroes, and all Italian and Chinese food - much too tasty for kids and teenagers !!!

FDA NEWS RELEASE

FDA Permits Marketing of E-Cigarette Products, Marking First Authorization of Its Kind by the Agency
Agency Also Denies Applications for Flavored Products for Failing to Demonstrate that Marketing of These Products Would Be Appropriate for the Protection of Public Health

".........The FDA issued marketing granted orders to R.J. Reynolds (RJR) Vapor Company for its Vuse Solo closed ENDS device and accompanying tobacco-flavored e-liquid pods, specifically, Vuse Solo Power Unit, Vuse Replacement Cartridge Original 4.8% G1, and Vuse Replacement Cartridge Original 4.8% G2. As the RJR Vapor Company submitted data to the FDA that demonstrated that marketing of these products is appropriate for the protection of public health, today’s authorization allows these products to be legally sold in the U.S......"

Really ?????

I've gotten down to 1.5 and occasionally 3 for nicotine strength - Is the FDA now stating that the only legal vape product I can buy must have 4.8 nicotine strength? Is the FDA saying that you must maintain a certain level of nicotine addiction to legally use vape products ???
