URGENT!

Up until Tuesday of this week (3/24),
SB 987 was a “shell bill” with no substantive provisions. This all changed when 31 pages of regulations were substituted and rushed through the legislative process. Currently the bill is likely to be heard in the House Rules Committee TOMORROW, Thursday, March 26th at the State Capitol Building (500 Woodlane Street) in Little Rock. We will update our members in AR when we know what time the hearing will take place.





It is our understanding that representatives of the Arkansas vapor industry were misled into believing that SB 978 would not place unnecessary restrictions on retailers or manufacturers. Unfortunately, this bill has moved out of their control and presents several challenges that must be fixed.


If passed, SB 978 would, among other things:

  • Lay the groundwork for future taxation of vapor products
  • Impose onerous paperwork requirements on industry
  • Require vapor retailers to only purchase their products only through wholesalers licensed by the State of Arkansas
  • Impose specific child-resistant packaging requirements that are not in line with existing federal regulation.
  • Become effective May 1st, meaning that many retailers will be forced to operate illegally if state bureaucrats are unable to dispense licenses in time.


Please take action NOW to oppose this bill!

Unfortunately I live in AR. This is the epitome of sneaky underhandedness. Sent an email in opposition but I can't miss work to go to the hearings . I sincerely hope my local shops can send some well spoken representatives and/or advocates to slap some sense and decency into these deceptive clowns. I hardly ever shop online due to the abundance of b&m's here and would love to continue shopping at them. Also would love not to see the very kind people that work in these places lose their jobs.

We updated to note that the hearing is scheduled for today (Thursday, 3-26-15) at approximately 1:00 and to ask for calls to the Speaker of the House Rep. Jeremy Gillam, at 501-729-0042, and let him know that you strongly oppose SB 978 and want an opportunity for the small- and medium-sized businesses--and the consumers they serve--to have an opportunity to participate in the process and share concerns.

Sadly it definitely is on the agenda for tomorrow.. It also covers search and seizure rules for consumers who buy out of state and don't pay taxes to AR, plus includes NON-nicotine e-liquid.

The bill as it stands now doesn't actually impose a tax on vapor products . . . but it sure sets the stage for it, requiring retailers to do all sorts of things (like maintaining receipts) that only make sense if there is a tax.

This bill is simply fraught with problems, and even though e-cigarettes are not actually defined as a tobacco product, they're stuffed into the tobacco product regulatory scheme in a frighteningly haphazard way, complete with all sorts of traps for the unwary and onerous (and unnecessary) requirements.

The bill must die or be completely replaced with a substitute amendment.

From my understanding, this bill was pulled by the author after hearing testimony from those opposing it. It is currently being rewritten with input by both AR vendors and vapers, and will be back up tomorrow. Unfortunately, this is a governor's bill so something is going to have to pass before end of session, and in waiting this long before publishing the text they almost pulled it over on us. I've been told that we do have representatives in attendance on our side however, so all is not lost. :)

CTA for Arkansas updated today (Friday, 3-27-15).

Yesterday, SB 978 was “pulled back” in order to consider changes that would address comments offered at today’s hearing. A special thanks is in order for all those that managed to attend and testify on such short notice. However, we still have no assurances that this bill will be amended favorably. Specifically, we are concerned that the requirement for retailers to procure their e-liquid only from licensed Arkansas wholesalers will remain. This is a clear indication that the legislature intends to impose a tax on vapor products in the future. We have updated our campaign to address this and other points.

Thank you for taking action yesterday, we need your help at least this one more time. Please take action now to oppose SB 978.

This bill has passed the House Rules Committee, in whatever form it's now taken.

Question: what is the legality of passing a bill that the public is not privy to?

Second Question; what is the legality of requiring manufacturers/wholesalers from other states to license in your state before they can sell to businesses there? Or maybe better put, what is the legality of only allowing businesses to purchase from manufacturers/wholesalers that are licensed in the business' state?

I am moving from this redneck, socially backwards state if this thing gets ridiculous. What is the point in voicing our side if they can just sneak in whatever bills and laws they want without informing the general public. They know what they are doing is morally wrong which is why they are making sure they rush it through and the pro-vaping crowd (or any crowd for that matter) can't pheasably do anything about it.

Kind of like a robbery, "get in there, get what we want and .... before someone catches us!"

I'm assuming the governor will sign it?

We kept hearing, "The governor is pushing this bill," so, yes, we expect he'll sign it.

And it's a real shame because the vast majority of the diverse vapor businesses in Arkansas did not support this legislation and were effectively shut out of the entire process.

Even if Governor Asa Hutchinson is planning to sign the bill, vape shop owners and vapers in Arkansas should contact him urging him to veto the bill, and telling him that it will destroy their businesses and make it difficult/illegal for Arkansas vapers to obtain e-liquid.

I may not be the savviest writer in the world but I sent the guv'na a little of what I think. Hopefully he gets enough of these in his inbox to force him to reconsider this mess. Just for kicks I reminded him vapers vote, too.

Also wanted to add a thank you to Bill and Julie and the others that update this section regularly. Honestly I wouldn't have even known about this if it wasn't for ecf.
