Casper, Wyoming Smoking ban.

The city of Casper, Wyoming is continuing work on the city smoking ban. This is my hometown. The last time it came up, I was in contact with every member of the City Council, as well as the Mayor and was assured that electronic cigarettes would not be a part of their ban.

However, this bill they're about to vote on specifically uses the word, 'vapor' in the smoking description.

I'm going to get on them again and try to get a ecigs specifically exempted.

TomCatt is right, the definition of "Smoke" or "Smoking" contained in this ban proposal would not cover e-cig use.

Here's the relevant paragraph:

  • “Smoke” or “Smoking” means the inhaling, exhaling, burning or carrying of any lighted tobacco product, weed, plant, nicotine, or other combustible product in a smoking instrument or the placement of smoking instruments containing a lighted tobacco product, weed, plant, nicotine, or other combustible product in an ashtray or other receptacle and allowing smoke or vapor to diffuse into the air. This definition does not include the burning of incense.

The term "lighted" in this context, particularly coupled with the term "combustible product", means burning or lit on fire. Thus despite the extraneous use of the term "vapor", what they are actually talking about is SMOKE, and e-cigs would not fit within the definition. They are neither lighted nor do they operate via combustion.
