DETAINED letter from FDA

So, my first order from Absolutly E-cigs back from Nov 09 never came. I emailed AE-cigs and they were more the cooperative in sending out a new shipment - which I recieved with no issue about a month later.
I just got a letter from the FDA, Chicago office stating that:
"The article appears to be a new drug without an approved new drug application" and that "a mail shipment is being held by the post office at the request of the FDA".

Anyone else ever get one of these??

Yes, same thing happening here. I was shocked to hear it because I heard about the court order "FDA not being able to detain any of that stuff" (Civil Case No. 09-771 (RJL)) so I contact the lady which she replied saying that she that she cannot forward the package without a request from Division of Import Operations and Policy requesting this to occur and gave me a cell or office phone number 301 area code. He then told me about the appeal and pretty much told me that it will take a very long time for it to get through if it ever does and that I better send my product back.

Any ideas if there is a set day for the appeals order?

I'm still here. I just don't know how much more of a rant I can give to the FDA and still be in compliance with the new ECF rules on videos. :D

I'm pretty sure people see the BS by now. It's no secret as to where the FDA stands.

Oh, you've done your job already. I'm just sayin' that for effect. ;)

I see you got 2 new vids up there. Your Moonport Special Alerts always have me ROTFL. Love that retro 70s ABC "Special" intro thing. :D

how big was your abecig order? was it a few attys or like a giant box?

2 boxes totaling about 600 bottles.

actually its to anyone in the US having the same issues, if we could send reminder emails to customs letting them know that the FDA lost the case, from a few thousand forum members we might get customs to release items that they are seizing in regards to e cigarettes course it might also piss them off....

Unfortunately sending a letter to customs won't do any good. We really did not "win" anything with this ruling. The only two that can have supplies go through is SE and N/Joy. Unless other distributors and manufacturers want to step in and join the current suit, everyone else is on their own and shipments will still be seized.

The FDA is playing by the letter of the ruling. Good for SE-N/Joy, bad for the rest of us.

I just recieved an order for 6 bottles of liquid from china that was ordered a couple weeks ago. didnt seem to get held up too long. maybe not enough to make them worry, as it is nowhere near 600 bottles.
I would like to see a video of DaDoctor getting to shove that big box up some government hiney, and am sure it was a rather large box. hehe

You are listed as a contact person for customs seizures of E-cigarette and E-cigarette liquid. As you should be well aware the FDA lost it's case when Judge Richard J. Leon of Federal District Court in Washington ordered that the FDA does not have the authority to regulate E-cigarettes as drug products. Why is the FDA continuing to delay the imports of E-cigarettes and E juice into the USA?

Does the FDA not realize that by withholding these products they are forcing US citizens to go back to using regular tobacco products that are known killers. Does the FDA not realize that tobacco smoking kills over 440 000 people a year in the USA alone. Don't take my word for it go read about it here: ACS :: Cigarette Smoking

Why is the FDA siding with big tobacco and not allowing e cigarettes which are the much safer alternative to tobacco smoking into the country? Please do some research, you will find that it overwhelmingly supports the E-cigarette to be 99 percent safer than smoking tobacco and at least 95 percent more effective at getting people to quit smoking tobacco through effective substitution of a non leathal habit.

The FDA's priority should be saving lives, not forcing people to do something that will slowly kill them. Please release e-cigarette shipments and e liquid and in doing so you can start to prevent the unwarranted deaths of over 440 000 US citizens a year and be a global leader in the fight against deadly tobacco.
