The CC company is largely out of this one - the place will just claim you didn't read the terms of the contract. File the dispute anyway, but it may not be successful.

It's time to contact the Attorney General, Consumer Affairs Division, in the State you reside. Several AG's have sued places like this regarding fraudulent business practices (and a 50% restocking fee is pretty damned fraudulent) once the complaints start rolling in. Getting an AG's office on their back by filing a complaint there will have a better success at getting the charge reversed.

That whole "...free lunch" thing. Yeah - that's still true.

This is the route to go!! Usually one simple letter from your states AG will get you your money back.

And if you happen to scroll down , at the very bottom under 'Terms & Conditions' the sordid truth is spelled out : Like fellow vapers suspected, unless you pull the plug hard and fast, you 'gain' membership to some club with regular shipments and regular payments.

But quote ' trial period ' start when you order the item .... it doesn't need a lawyer, a law student will do to roast 'em on that clause alone..

Trial means having access or disposal of the goods...can't try something that's gathering dust on their shelves or while it's " in the mail ".

I'd take screen shots and waltz right into the next police station with them...

And maybe the quoted newspapers would like to have a copy :D

Could be interesting how their legal departments feel about lending - unwittingly - credibility to a very dubious business ...

I have to say I used to work for my States AG office in the victim's rights unit. I watched plenty of people lose the shirts off their backs from scam artists. It is a crime that is more devastating to people than most realize. It is a violation of trust.

I am really sorry to hear what happened to you. I agree with other posters, contact your CC company, and your states AG and the AG in the state of of the company. You should be able to file a complaint in both states.

You also can file a complaint of mail fraud with the US Postmaster General if it was shipped via the postal service.
 
I know it does no good and those FREE offers sound so good they can draw US in sometimes. It all in the tiny print and the automatic shipping, automatic enrollment wording. I read a "sticky" here in "New Members" warning of just such 'scams' or perhaps 'questionable offers' is better, a bad idea either way. Some helpful reminders from a concerned member dating back to 2010 I believe:

This. These fly by night companies will often charge you a recurring fee, or even start charging you for other things. Dispute the charge with your cc company (you tried to cancel the shipment well before it went out, you have a leg to stand on.) and then have your card number changed.

And, they get away with it time and time again, because most people don't follow up on it.

Yeah, it's been going on forever. Not just with e-cigs, BTW.

Scammers are everywhere--don't trust anyone, don't click on links in emails, do not respond to 1-ring phone calls, check your credit cards for suspicious activity (the $9.84 scam), cancel your Target cards.... :facepalm:

Yeah I learned my lesson on this with the free credit score offers... *sigh* And pretty much ANYTHING that comes in email! I guess these guys operate on the P.T. Barnum theory: there's one born every minute.

Now I just always remember: TANSTAAFL! (thanks, Mr. Heinlein!)

Sorry you had to learn it the hard way, with such a noble endeavor as trying to give up cigarettes; they really oughta be ashamed. But I'm sure they're not, they're just on to the NEXT "one born every minute."

I received a "spam" E-Mail from SinlessVapor.com offering a FREE Starter Kit. Just pay the shipping $4.95 and it is yours. Stupid me, I went ahead and paid the $4.95. Then I went to their website and read the disclaimer: If you don't like it, then return it within 12 days, otherwise we will charge you $99.95... Ouch, my mistake. I immediately called them and asked NOT to ship it - they lied, telling me that it is too late, it has already been shipped. Two week later I received E-Mail that is has just been shipped. I called again and was told to wait until it arrives and return it not to Shipper, but to a different address using the RMA number they gave me. Two more weeks later (total of 4 weeks time) a cheap, no name single 650mah battery starter kit arrives. The kind that you will find in a Tabaco store for $9.99 or less. And the next day a $99.95 charge appears on my credit card account because the 12 day trial period had passed long ago before they even shipped the product. I shipped it back (unopened and untouched) on the same day I've received it. Today I received an E-Mail from them that my account is credited $50.00 because they have 50% Restocking Fee!!! That's $4.95 + $99.95 + $12.00 (return shipping) - $50.00 = $66.90 it costs me and I didn't even get to keep the product. Sucker (Me)!!!:mad:

There are so damn many of these preying on new ecig users. Usually at the bottom of the page there is in small print "Terms". If you click on it spells out the ridiculous purchase price an month rip off there after. Many of us have been burned on these the first time around. Don't feel bad. Dispute the charge with your credit card company. You will win.
 
I too, made the mistake of falling for this SCAM! I called them immediately after I saw the $99.95 debit to my account. Of course, I was speaking with someone I could not understand. Unfortunately, I am in a bind because:
#1. I never received the Trial Package (even though they have a Tracking Number saying it was delivered by UPS).
#2. I have no proof of the non-delivery to even return for a refund.
#3. I ADAMANTLY expressed my request to be Cancelled immediately and asked to have an email sent to me saying it was cancelled as I was on the phone with their 'Customer Service'. I wanted to see the email actually come through. Of course, I got the runaround that 'she' was not the person that would actually be cancelling it. She only puts in the order for cancellation.
#4 The Customer Service person gave me a cancellation number and told me I would receive a confirmation of the cancellation within 24 hours.
#5 As soon as I hung up the phone with this person, I immediately contacted my bank alerting them to this scam and to not accept any further charges from them. I have also asked for my current debit card to be cancelled and sent a new one.
PLEASE PLEASE PLEASE DO NOT BE SWAYED BY THIS $4.95 FREE TRIAL SCAM!!!!!!
