The government is just trying to shakedown the e-cig industry. They've come in, looked around and said "Nice place you got here - it'd be a shame if something happened to it". They've proposed measures for maximum effect, hoping to leverage fear into some long-term financial windfalls from the industry. This is America. You're freedom is proportionate to your wealth.
