Here is eBay's policy:

Most tobacco products can't be sold on eBay because of strict government regulations. This includes things like:
Blunts or cigar wraps
Cigarettes, including flavored cigarettes
Cigars, including Cuban cigars
Collectible items where the tobacco is higher in value than the collectibles
Collectible tobacco packaging that has been opened and contains tobacco
Electronic cigarettes (e-cigarettes) or accessories
Herbal cigarettes or herbal tobacco (sometimes called nicotine-free cigarettes or tobacco-free cigarettes)
Hookah or Shisha molasses that contains tobacco
Nicotine inhalers or nasal sprays (see our prescription drugs policy for more details)
Pipe tobacco
Smokeless tobacco
Tobacco items currently available in stores

Regardless of ebay's policies, go on there and do a search for electronic cigarette and they will show up and not just coupons. They are mostly cheap crap that you can get on dealextreme for as little as $6.00 selling for 20 to 40 dollars. You get free shipping though. I saw one eGo kit selling for about twice what it should have. They are there though. Found some juice too.

Are there any government regulations related to e-cigs? Isn't EBAY just making this up just to be safe?

There are no regulations in the US right now, though the FDA will eventually be regulating E-cigs as a tobacco product now that they've lost the case for classifying them as drug delivery devices. Health Canada up here in the north still won't let juice containing nicotine be sold here and have pegged a few vendors for doing so -- though at least one of them moved their operation to the US to avoid that. It isn't officially regulated in Canada yet, Health Canada is just trying to do what the FDA tried to do. Hopefully with the FDA now officially deciding to regulate as a tobacco product, Health Canada will loosen up a bit.

As for eBay, I wouldn't trust stuff from eBay. There are far too many counterfeit sellers there for me to trust a number of products. I'd never buy E-cigs there, nor Gillette blades, memory cards, thumb drives, or headphones unless I could certify that the seller is selling genuine products.

Once eBay catches up to the seller, they will get kicked and then warned. If the seller keeps relisting them, they will eventually have their accounts banned.

Tobacco and nic juice are not allowed even with FDA approval.

Most of what's on there is total junk to an eye that knows the difference. They are selling to those that don't.

None whatsoever. That guy hasn't got the foggiest clue as to what he's talking about. The fact of the matter is that eBay is a private company that doesn't allow the sale of ecigs on their site per their terms of usage. It has absolutely nothing go do with government regulations. They don't allow the sale of lots of perfectly legal items and since, like I said, they're a private company, its their right to decide what they do and do not allow on their website.

Edit: They have a charger on there (looks like my 510 charger) they didn't even say what model it charges. I feel for anyone who buys their kits off ebay they're going to have problems hunting down replacement parts or pay too much... or both.
