Hi everybody! I promised you all an update today and, to that end, I will do my best, but the simple fact is that we still don't know exactly what's going on!
The Trialogue was held behind closed doors in Brussels on 03 December 2013. We watched and waited for a press release, but nothing came. The only real "news" came in the form of tweets from
Frédérique Ries, a Belgian MEP and a lady who we now recognise as being one of our most important friends/allies in Europe. The tweet which caught our attention and was subsequently shared on
vaping forums across the EU was this one:
#EP #Trilogue #Tobacco Total deadlock in discussions. Council now proposes to ban the #ecig beyond 5mg nicotine/ml.

here. What does "deadlock" mean? Simply that the Coucil was unable to reach a majority decision (click
here for an explanation of majority voting in the Council of the EU). This could either be seen as a "stay of execution" or yet another indication that the TPD is so flawed and so utterly unreasonable that it will never be accepted in its current form - depending on whether you're a Protank half full/half empty kind of vaper!
To add a bit of balance to the proceedings: Karl Heinz Flrenz, a German MEP, made a
claim via
Parliamentwatch later on 03 December 2013 that 23 member states support medical regs. What follows is a Google translation of his comment:
Dear Mr. March Field ,
Thank you for your message to " e- cigarettes " that made me on 28 November has reached across seconded watch . As a preliminary to say that apart from four EU Member States (Poland, Czech Republic, Romania and Bulgaria), all Member States have supported the general approach of the Council in June 2013 , which is the mandate of the Council in the ongoing negotiations with the Parliament. This means that 23 Member States have expressed support for regulation of e- cigarette in the framework of drug policy in June.
The impact assessment of the European Commission (see page 181ff ec.europa.eu ) , which it has carried out in preparation for the revision of the Tobacco Products Directive , it is found that 14 Member States would already classify e- cigarettes as medical devices. Two Member States have e- cigarettes even banned . Nine Member States have no specific rules .
I hope to have helped you with my comments , and remain
Yours sincerely ,
Your Karl- Heinz Florenz
Quite what happens from here: I just don't know. The situation described by Jo Lincoln in her recent blog post "
Ever closer union (democracy optional)" remains largely unchanged and there have been rumours of another meeting to be held on 16 December 2013. The way I see it: every time these negotiations are derailed (as they were on 03 December 2013), we move a baby step closer to having them thrown out altogether. Whist the politicians are arguing amongst themselves, we are growing in numbers and our voices are getting louder and louder. There will come a point when we are too large and too loud a group for them to continue to try to ignore us and, in doing so, treat us with such contempt.
