Vape companies should be funding this suit. If you buy ejuice and vape gear from these companies, you already funded it imo. These huge vape companies spend 30,000 for a booth at vape conventions, and make lots of money from us. Rip trippers donated 300,000 for the first suit and hes just a youtuber. vaping needs less greedy companies and more lobbyists paid by these companies or vaping will have to be underground in the future.

On May 22nd, a fundraising page was launched by the plaintiffs, in coordination with a vaping media site, to help fund the appeal. After a request from CASAA, the fundraiser organizers made changes to the campaign to make it clear that while any donations are appreciated, this should be an industry-funded effort. At the end of the day, this is an industry-led lawsuit, and we believe industry is where the funding should come from. There are many large vapor product companies that have contributed little, if anything, to advocacy efforts, and it’s time for them to stop getting a free ride.

CASAA supports the lawsuit, and our only concern, which has been largely addressed by the organizers, is that consumers shouldn’t feel pressured to donate money to the fundraiser. Consumers are not a party to the lawsuit, and we have no input into legal strategies, nor are we privy to the kind of information that clients would ordinarily receive. And in a very real sense, consumers have been supporting this lawsuit since the beginning. CASAA, as an advocate for consumers, has provided support for the lawsuit, both at the district level and at the appellate level. Specifically, we’ve spent a considerable amount in legal fees not only for CASAA’s amicus brief, but also to assist other groups to file their own amicus briefs.

I agree that consumers shouldn’t feel pressured to donate, and that large vape businesses should participate. But for every large business, there are 100 little Mom and pop shops doing their best to keep the doors open while competing with online shops.

And, I see a large chunk of the donated money IS from shops.

And, it’s my money. I’ll donate when and to whom I please. Because as a consumer, I should not feel pressured NOT to donate.

I mean, our tax dollars already pay for our military. We already contribute, with the idea being, the government is going to take care of our vets. Does that mean I shouldn’t donate to those causes?

Anyone who doesn’t feel the desire, or have the means, should not feel pressured to give. Fine. Then don’t. And drop it.

Probably we could ASK our suppliers, in their areas, if they are going to donate, and if they do, well, we could state that we would support them, and etc. Or, make a memorial purchase (although many of them are probably off having their weekends) but yeah, we can ask ourselves, right?

The sad thing is online retailers are missing a golden opportunity here. If I owned one, I would have a promotion where a set % of all sales went directly to this campaign. This would not only help the cause but would generate a ton of word of mouth advertising for them. IMHO they are ALL missing the boat on this one.

I would guess most don't have a clue.
Not everyone does the online community things to hear about happenings.

This is why we need to educate them. Most vape consumers like us can't afford to make the large donations that businesses can, so it's our job to get the word out. We can email online vendors
and take flyers to vape shops.

Now officially one week into the #FUNDtheSUIT campaign, a total of 63 percent of the goal has been raised — $156,311 of the $250,000 goal.

Thanks to the outstanding generosity of the industry, it’s businesses, and even its consumers, we expect to hit the goal.

I don't know if this lawsuit can be won
Well... correct me if I'm wrong but the lawsuit was thrown out in the first instance and this now is an appeal.
There may be a very slight chance the appeals court will go on with the case but I think it's likely they'll just dismiss it (based on the reasons I saw the first court cited to dismiss the case).
The problem is there's a 2009 statute that gives the FDA power over tobacco products and the FDA has the authority (through that very law, the TCA) to classify ecigs as tobacco products. So unless there's anything done about that law the courts won't have much wiggle room at all, they interpret the law, they don't make it.

The FDA could treat ecigs less strictly if they wanted to but I doubt they can legally be compelled to do so.

That's how I see it atm, hope I'm wrong (and there's a good chance I am, only studied 1 semester of law and not even in the US, so definitely not an expert on those matters).

The speed with which the #FUNDtheSUIT campaign has surpassed its goal has simply astonished me.

I am so proud to see how many companies, stores, state associations and individuals came through to keep the lawsuit going.

With that said, since we have exceeded our $250,000 goal, it's time to call the GoFundMe portion to a close. There are sooo many people to thank for their hard work on this — my team here at VAPE News for all of their efforts, Fig Ramsey for more than I can put into words, Grimm Green, The Vaping Bogan, R2BSF, Huy Nguyen and Naked 100, Innokin, Drip More and so many others. I sincerely apologize if I've forgotten to list anyone.

I know many stores and companies are still running promotions for this, and there is still a place for your help. Moving forward, this fight continues. As we said in the beginning, the goal was a conservative estimate. In addition, there are other active cases as we speak. The more of these in which the industry can intervene the better.
