I can't fault the court or hana modz for the lawsuit. Make a clone if you will and advertise it as a clone of XXX but don't copy the name. That is an outright deception. So I agree with this lawsuit. It's like Rob's patent on the Reo. Go ahead and make your version but don't call it a Reo.

I buy some clones. I can't afford authentic gear all the time. I think my dna 30 uses the same box as Hana does but it has NO markings and is not a 1:1 clone. It was probably more expensive than Hana's version. But, as I said. I have no problem with clones as long as they don't forge the name of the original manufacturer. People can choose to buy what they want based on reviews and research. I have heard of clones that were actually better than the authentic.

No trademarked logos at least. (no idea what % have actually trademarked their logo)

Case was relatively cut and dry since Illvapes (IIRC) literally used pics straight from Hana's site to advertise the clones intially, and ignored initial warnings/cease and desists, etc.

Since they made no effort to even fight it, and likely carry no insurance, i assume $307,000 will be the end of Illvapes.

Yeah the big thing is it wasn't the fact that it was a /clone/ that was a problem it's the fact that they used Registered Trademarks to advertise their products.
It's a Trademark infringement case. They'll still sell hana clone mods, you just can't call them a Hana Clone because it uses the Hana trademark.

And that's fine (IMHO) but it's just stupid and crappy to use registered trademarks. I do respect the R&D that goes into these creations. Just think about the uproar if someone cloned The Virus and called it Nicoticket, The Virus and used Clark's labels etc. We would have pitchforks and torches in hand!
