So our President signed the anti-smoking bill and thus far I’m not seeing where electronic cigarettes are being targeted for distinction. I’m certain that anyone reading this will agree, that the content and direction of the legislation is supported even by us who use the electronic cigarette. I for one believe that we (as a nation) need to create an environment which will be inhospitable for minors (or anyone for that matter) to consciously become addicted to something as destructive as tobacco.

That said, when looking over the verbiage used in the bill doesn’t appear to be targeting the manufacturers of electronic cigarettes or eliquids. On the other hand I do see how eliquids could be associated by proxy due to the flavors advertised.

Is there anyone out there who can post material clarifying if the bill that was signed can be used to associate eliquid into the ‘flavor’ ideals of the bill? Not understanding all of the facets & jargon used, the terminology appears to be specifically targeting tobacco. Will this bill also be used for the elimination of the eLiquids?

*Of course one could argue that jargon and/or verbiage used in any bill/law/ordinance could be used to attack something not specifically listed in legislation; however the spirit of this post is to try and find the loop-holes that the anti-smoking reps will be using to try and target our beloved eCigs.

It comes down to interpretation and enforcement of what the FDA wants to do. They could perceive the right to regulate our nicotine and then it becomes our responsibility to fight them. If they deem an e-cig to be a medical device then they already have jurisdiction to control them, with or without this law. It is not solely about this law. They have already seized major shipments at the border. You are right about them not being specifically worded into the bill, but the FDA has already taken a stand against them.

I believe this thread can be closed, I’ve seen the bulk of the verbiage used for the new Marlboro Bill via e-cig.org and it clearly shows that the Bill is targeting tobacco plants and the marketing of the tobacco industry. Though there are some gray area’s left for the FDA to use for trying to interfere with the proliferation of electronic cigarettes, there’s nothing in the Bill stating that electronic cigarettes are targeted for being banned. At least thus far, it appears that the FDA will need to create a new set of legislation to target eLiquid and electronic cigarettes. Anyone claiming that a ban is pending, is at least for now, basing those claims on pure speculation.
