I think it was Harmony a few months back asking about the Barbara Lawton memo stating the smoking ban did not cover vaping.

For your reference, here is the statutory definition of smoking (from Wis 101.123(1)(h) (intro.)):

"Smoking" means burning or holding, or inhaling or exhaling smoke from, any of the following items containing tobacco:

1. A lighted cigar.
2. A lighted cigarette.
3. A lighted pipe.
4. Any other lighted smoking equipment.

Thanks for the confirmation MlrGrl!

I recieved a call from Sarah Ann Shannahan, who is running for the assembly in our district, and we talked about ecigs and smoking bans. She agreed with me that there is enough negative stuff being slung at smokers and that the smoking ban in bars should be lifted for bars who have ventilation systems and we talked about ecigs. She didn't know a lot about them, and I explained how they much safer they are than cigs. She thanked me for the heads up on them. Hopefully if anything comes up in the legislature, she will show us some love. (If she gets elected)

At any rate, this confirms that a ban on ecigs would have to go through the legislature. Hopefully, it will be a low priority and never gets on the table.
