Let's not go overboard here. We're glad to have someone familiar with trademark law but at this time, the only comment about this has been from a member here who is not involved with either party. So, there is no need to get all legal about it. No one is trying to copy anyone else as far as we know.
Not going overboard...I'm just stating what Drew legally has to do if he becomes aware of this site. When you trademark something, you have to defend that trademark if you become aware of an infringer.
It does not matter if the infringing party infringes intentionally or not. Intent does not matter. All that matters is that the name is too similar to his brand, and that both parties are in the same business.
The moment someone wrote "Newhaler.com" the first thing that came to mind was Nhaler.com. I'm not the only one. That means that the name is too similar to Nhaler.com and particularly because they sell the same product. Drew is legally bound to take some sort of action in order to protect his brand.
That is how it works...don't shoot the messenger.
