Hey guys,

this is from HC:

5.2.2 Canadians importing by means other than on their person (via mail, courier, etc.)

Consumers are encouraged to buy health products which have received market authorization from Health Canada. Market authorization indicates that a product has been reviewed by Health Canada for safety and efficacy and found to have an acceptable risk/benefit profile for the conditions for which it was approved. Health Canada also conducts post-market activities for these products, including the monitoring of adverse reactions and complaints regarding quality. Consumers are also encouraged to obtain their health products only from reputable or known suppliers/retailers.

A Canadian who chooses to obtain a health product from outside Canada which may or may not have been reviewed and market authorized by Health Canada is allowed to import:

A single course of treatment or a 90-day supply based on the directions for use, whichever is less, of a health product as long as the product does not contain a substance listed in Schedule F of the Food and Drug Regulations.
The health product must be for their own personal use, the use of a person for whom they are responsible or for use on an animal for which they are responsible.

The health products must be in one of the following:

Hospital or pharmacy dispensed packaging;
Original retail packaging; or
have the original label affixed to it which clearly indicates what the health product is and what it contains.
Larger volumes shipments, multiple repeat shipments of the same product within short periods of time (<3 months), shipments accompanied by or associated with materials to be used for advertising or promotion, and/or shipments that indicate a Canadian business is involved in the transaction, will be considered commercial shipments and the relevant requirements will apply (see section 5.1).

12. In cases where a required drug is not available in Canada, physicians, dentists, and veterinarians may seek authorization from Health Canada to import the drug through the emergency drug release provisions of the Food and Drug Regulations. If authorization is granted, Health Canada will provide a Letter of Authorization to the practitioner. This letter will usually accompany the shipment and must be presented to customs to obtain release of the drug.

Bottom line, I doubt it....

There was a member from Canada who said that he lived close to the border and got a prescription from his doctor... he said he would order from U.S vendors, get it delivered to a U.S address and then drive across the border to get it. He said that he actually claimed the nic juice, showed his prescription and customs allowed it. I'll search for it and see if I can get a link to the conversation ( I had posted back to him). There was some disbelief, but he stood by his story... like he said, what reason would he have to make it up.

Bottom line, I doubt it....

You are very much allowed to look for treatment outside of Canada or territories outside of which you live, and if you can get a valid reason for requiring it, it will be allowable to CRA as a medical expense on your tax return. There do however, have to be studies that prove you require or benefit from it, and there is not a similar treatment in your own healthcare system. If those 2 qualify, they can not refuse you the expense or the delivery of said treatment.

It's a hard line to cross, but if you can get your toe over it, it's easy peasey. Once a decision is made on it in your favor they cannot repeal it, but if they agree against you the appeal process can be an insurmountable hurdle.

I wonder how many doctors would be open to this idea? I know very few with publicly stand up for it, but behind closed doors it seems to be a different story. Would they get a slap on the hand from HC?

It's very unlikely that many of them would want to rattle HC doors, especially with whats going on in AB right now, and they get such a long probationary time when they immigrate to Canada. They agree to accept HC as the final word when they transfer their MD to Canada and agree to abide by HCs every last statement whether they agree with it or not. It's all part of the ethics clause which I find a very hypocritical oath, so they have to closet agree or disagree.

They need university research to help them out and even if they were right they get no right to say "hah ha told you so."
