Not sure what to make of Law and Order Episode

This week's L&O episode has a gal being questioned while vaping a black cigalike. She says, "You know, if my cigarette bothers you, maybe I could just talk to him." Mariska just replies, "absolutely". It was really a weird exchange. I don't like the implication that the e cig was bothering anyone.

Could be that the producers inserted what they believed would be a "politically correct" comment in a scene reflecting a current, real-life hot topic.
I have noticed this technique many times----TV and movies are famous for going out of their way to ensure politically-correct dialogue, behavior and point-of-view on a current topic.
(Except in this case they are dead wrong.)
