Personal E_liquid sell

I wonder how a personal e liquid sell would be treated by the law, let's say that I have an overstock and I want to sell part of it but I want to sell it person to person.

As long as your not doing all the time it should be a problem, kind of like a garage sale, Start selling it all the time and your state will want it's share of sales tax on it because they will start thinking your a business.
