It took me a while to figure out what you were talking about, since the page you linked to had nothing but innocuous discussion. I went to the last page and found this:

I don't know what NACS is. Currently, the FDA has not begun regulating e-cigarettes. The agency will need first to promulgate a regulation to claim that they have the authority to regulate e-cigarettes under the Tobacco Act. Technically, the Tobacco Act only gave them authority over cigarettes and smokeless tobacco. So this is an issue that would need to be cleared up before the FDA even gets to the point of actually issuing regulations
about e-cigarettes that directly affect the manufacture and sale of products.
Currently it is unclear whether the Tobacco Act gives the FDA authority to regulate dissolvable tobacco products such as orbs, strips, and sticks. Bill, Greg, and I are all going to testify at the next TPSAC meeting (November 3) regarding dissolvables.
