Interesting... I definitely wouldn't say the horse is outta the barn. I have a friend whose cousin actually knocked off those moose glasses (you know from x-mas vacation). The guy who originally made them didn't copyright or patent and the guy with the knock offs got a patent then.... sued the original maker.

So this is certainly something to be concerned about.

Someone's council needs to be disbarred if that's the "whole story". And regardless, the original manufacturer can still have the patent overturned.

Look up "prior art". A patent can't be had where there's prior art.

In this case, it's not patent protection, it's trademark and copyright. And we don't even know who the "original" was, I suspect, so there's really no way to be calling this unless someone here has had prior art searches done.

Actual product: VaporKing Vaporizer

But it's not an e-cig... though it's being advertised as a smoking alternative.
"The VaporKing Vaporizer Hands Free is a convection based vaporizer that draws hot air over your legal herbal blend causing it to vaporize."

Anyway - that was just one I found in a quick search. Might be a good idea for v4l to grab a TM if they can.

I suspect the 'horse is way out of the barn' may be correct.

We don't even know which one coined the term Vapor King. So who knows which one came first? I trademarked my product name because I knew I made it up and others were using it to confuse the public. But, in the event you do have a trademark, it is useless unless you vigorously defend it, it's one of those use it or lose it things and defense is costly if cease and desists don't deter them.

There are dozens of other companies that call one model or another "Vapor King". Do a Google search with Vapor King in quotes. V4L should be the first and second listings but the pages go on and on. One company in particular has a really bad rep and they are selling a vapor king.

Like I said, on a trademark issue with what has become common terms the horse is in another country by now. Patents are a tad different, trademarks are a little more difficult to defend.

BTW: If anyone doesn't have V4L come up at least 3rd in that list, please PM me.

Well I went to google and put in " e-cig" to see what everyone else is saying about Judge Leon and I just came across electroniccigarettesinc selling a 510 called the Vapor King. I thought I was going to be reading some PR news on V4L. Thats just not right and it will confuse others who are interested. Now I will have to make sure I tell everyone its the Vapor King @ vapor4life and not the other one. I hope you have your stuff (trademark, and rights) together so you can do something about this Steve because this is infringement!
