a plea to the mods and admins: PLEASE aid in raising awareness about this tax bill https://www.popvox.com/bills/us/112/s1403 I think this is the biggest danger to us since SE/njoy vs. FDA. if this bill passes, E-cigarettes WILL be taxed the equivalent to analogs, and if this happens, we will lose EVERYTHING we have worked for. just about all of the suppliers will go bankrupt and nobody will be able to afford E-cigarettes. those of us who see this coming can stock up now, but any chances of getting any more new users will be extinguished. what you can do about this, if you haven't already, is click on the link, sign up, and vote "no" on this bill. POPvox is a new way to alert congress about public opinion of a bill, and it sends the data of people who voted in it to all senators and representatives. Think of it like a straw poll for bills. It is very important that we get as many "no" votes as possible. anybody reading this please, PLEASE take 2 minutes to sign up, vote no, and comment on it if you've got anything to say.

I am somewhat confused.

Here is an excerpt of the full text.

‘(i) Other Tobacco Products- Any product not otherwise described under this section that has been determined to be a tobacco product by the Food and Drug Administration through its authorities under the Family Smoking Prevention and Control Act shall be taxed at a level of tax equivalent to the tax rate for cigarettes on an estimated per use basis as determined by the Secretary.’.

(g) Clarifying Other Tobacco Tax Definitions-

(1) TOBACCO PRODUCT DEFINITION- Section 5702(c) of the Internal Revenue Code of 1986 is amended by inserting before the period the following: ‘, and any other product containing tobacco that is intended or expected to be consumed’.

(2) CIGARETTE PAPER DEFINITION- Section 5702(e) of such Code is amended by striking ‘except tobacco,’ and inserting ‘or cigar (other than roll-your-own tobacco)’.

(3) CIGARETTE TUBE DEFINITION- Section 5702(f) of such Code is amended by inserting before the period ‘or cigars’.

(4) IMPORTER DEFINITION- Section 5702(k) of such Code is amended by inserting ‘or any other tobacco product’ after ‘cigars or cigarettes’.

As introduced, S. 1403 would:



* Double the cigarette, RYO and small cigar tax rate (from $1.0066 to $2.01 per/pack)



* Increase the pipe tobacco tax 17 fold (from $2.8311 to $49.55 per pound, or to $2.01 per pack if used as RYO)



* Increase the snuff tax 18 fold (from $1.51 to $26.79 per lb., or from $.0944 to $1.675 per ounce),



* Tax dissolvables, snus and other portioned smokeless products at $.10 per dose unit portion)



* Tax e-cigarettes at the same rate as far more hazardous tobacco cigarettes, and



* Adjust all tobacco tax rates for inflation annually.

alright, here's my idea for a sticky thread (it's what Laurel said with a little more added to it):

ATTENTION ANYBODY THAT USES ANY TOBACCO PRODUCT OR E-CIG OF ANY KIND: There is a bill proposed in congress called S. 1403, AKA the IDEA full funding act.

S. 1403, was introduced on July 21, and referred to the Senate Finance Committee, chaired by Mac Baucus (who isn't a sponsor of the bill), with Orrin Hatch its ranking member.



As introduced, S. 1403 would:

There IS something you can do to stop this: this bill hasn't gone to an official vote yet nor does it have a set date to thus far. The US legislative branch has a new online system for people to tell them how they feel about new bills online. This system is called POPVOX. POPVOX is basically the straw polls for bills in congress. On popvox you can cast a vote stating whether you support or oppose a bill and you can even comment as to why you feel this way. the page on POPVOX for this particular bill can be found here https://www.popvox.com/bills/us/112/s1403 SIGN UP NOW AND VOTE NO!

Are e-Liquids consider to be a "Tobacco Product" by the FDA as it pertains to this wording?
after the SE/Njoy VS the FDA court case, E-cigs are to be regulated by the FDA as tobacco products, so yes, they are.

1. What do you do when you get there, as there are a bunch of bills on there and nothing specifically says "more tax on tobacco", which is what we are on about here.

2. Exactly what do you want people to do: sign up, login, and OPPOSE the bill?

On further investigation, it looks as if the tax hike has been camouflaged inside some bill about changing an Act concerning disabled persons' education. Is this correct?

If so, we should post an instruction that says something like this:

you'd be correct. there's actually a huge discussion about this in the legislation news section as well. I honestly don't care HOW you do it, just get this out there! there are 64,000 users on this forum, and we need ALL of them to oppose this.
