None of these so-called "electronic cigarettes" is covered by an approved NDA. Thus, the marketing of them in the United States would be subject to enforcement action, which is why your products have been detained.

Just to clear things up, e-Cigs are not illegal in the US. There have been some issues getting things through customs as the FDA is taking a closer look, but at this point there is nothing to worry about other than your favorite supplier may be low on stock for a little bit while customs paws through there order.

You can search through the government database and they will give you the reason as to why something was stopped. In all cases, the boxes were marked improperly.

We should be thankful that customs is doing it's job and stopping packages coming into the US that aren't marked properly. Whether it is a kids toy, an e-cig or anthrax.

Lacey but the packages been seized was described as "e-cigarettes" so how this is going? if a sender marks them as "e-cigarettes" will be seized or not? if they mark them anything else then is it a lie?

To me the importers of that packages just marked them "properly" I'm very confused here, if I send a package with a description like "electronic cigarette" and is held in customs, they gonna seized it like with those examples?

Also in that letter they make reference to "electronic cigarettes" specificly so I don't know how to interprete that

Lithium - I can see your concern. But I can tell you this. Most of the suppliers are not having problems. We just aren't. And many of the suppliers will tell you that if their packages are marked properly, they don't seem to have these problems. There does seem to be a geographical issue with customs offices.

Also, let's look at the fact that all of these are listed as cigarettes and not what they are, vaporizers. Oh... and one is marked as "quick quit". Mis-marked.

But then again, I import them in fairly large quantities and almost weekly, so what do I know?

And yes... they will stop an electronic cigarette. Why? Because WTF is an electronic cigarette? There is no listing for them, so they are "new". However, they are not new when marked properly. No... marking them properly for what they really are is not a lie.

The FDA statement seems to clearly say that 'electronic cigarettes' are subject to enforcement action. Whether they do or don't enforce their control at the moment does not mean they can't or won't whenever they see fit.

Well I'm sure time will tell. They obviously think they have jurisdiction over 'electronic cigarettes' and have exercised it on certain occasions. If these things become more high profile or are seen as a public health risk they might start enforcing their rules on all shipments.

Look, I spent about 3+ hours yesterday dealing with DHL, and discussing the customs issues regarding the FDA. Not to mention I fully expressed my opinion about the FDA's position into all of this. We clearly recognize the research has been done I know of at least 3 labs throughout the globe that have performed the requested research and the results are EXCELLENT. (Why isn't this being submitted to the FDA, well it is... and they just aren't listening - though I am sure they have some B.S. specifics as to why really).

Anyhow, we have had issues with CUSTOMS and DHL this week. Here is some things I also have on TAPE from what I was told by DHL.

- FDA has the ability to control ANYTHING that comes/goes through borders.

- They can "REGULATE ANYTHING THAT TOUCHES YOUR BODY"

- DHL even said "Sunglasses" are regulated by the FDA (We found this to be true)

- Electronic Cigarettes are not yet categorized, therefore are not regulated/approved by the FDA to come through customs. Most packages are rejected or confiscated.

- Anything 'mismarked or misrepresented' is ILLEGAL.

- I asked them about "Rules" as to what to follow, DHL said FDA doesn't have to have any rules.

- Since a package is caught if misrepresented, then the ORIGINS address is then 'flagged' in the system for FUTURE SHIPMENTS, this means that ANY VENDOR who ships into the US and "CHEATS" the system, if CAUGHT will have a even harder time getting anything in, in the future.
