This FOX 2 Detroit news report on proposed #vaping taxes in Michigan irresponsibly conflates lung injury deaths - which strong scientific evidence shows were caused by vitamin E acetate in illicit THC vapes - with the nicotine products targeted by the tax.

Along with the possible tax, Michigan manufacturers, retailers and adults who benefit from reduced harm tobacco and #vaping products are also facing a slew of other anti-harm reduction/anti-vaping laws.

The Governor's Action Deadline for these bills was last night at 11:59 p.m. He amended the bills and sent them back to the legislature. His explanation for why he amended them was "Liquid nicotine and nicotine vapor products; certification and directory, penalties". I'm not sure what that means. Now the legislature has to decide if they want to accept his amendment when they come back for the veto session.

VIRGINIA UPDATE

Governor Youngkin has returned HB 1069 to the House with proposed amendments to “remove the Attorney General’s authority to bring the court action or to concur with such an action by a Commonwealth’s Attorney or local government attorney. The amendments also propose to allow the Commonwealth’s Attorney or local government attorney to recoup costs of investigation and attorney fees and would provide that civil penalties in an action brought in the name of a locality would be paid into the local general fund.” The amendment would also postpone enforcement of the PMTA registry until July 1, 2025.

The General Assembly will reconvene on April 17 to consider the amendment, which could be accepted as is (the bill would then become law), or the change could be overridden by a two-thirds vote (and the law passed with the original enforcement dates).

LB 388, a 20% vape tax, is listed as passed (second reading), but there is a third reading and final vote before this leaves the legislature. We expect this vote to happen on Thursday, April 18!

Thanks Kristin. It sounds like the amendment just gives vape shops a little extra time and makes enforcement of the law a local issue. In the long run our B&Ms are still attached to another object by an inclined plane, wrapped helically around an axis.

While LB 388 didn't advance in the regular session that ended April 18th, it's STILL ALIVE. Governor Pillen is promising a SPECIAL SESSION to address property tax relief, which could include the bill's 20% tax on vaping products!

This is a typically myopic take by Tobacco Control. Nothing but complete abstinence is acceptable.

Never mind that youth vaping is lower today than it was in 2014.

Never mind that millions of adults are no longer inhaling deadly smoke because they're vaping instead.

Never mind that the benefits of adults quitting smoking clearly far outweigh the risks of youth vaping.

Never mind that there's no evidence that youth vaping leads to youth smoking, but there's a lot of evidence showing that youth vaping is a substitute for smoking.

Never mind that everyone knows that it's the SMOKE that causes 99% of the harm, not the nicotine dependency, so continued use isn't as concerning as they make it out to be.

Never mind that e-cigarettes weren't created to act as nicotine cessation products, but instead were meant to be low risk replacements for deadly cigarettes for adults who cannot or will not quit.

Never mind all of that.

All that matters (to them) is 100% abstinence from nicotine regardless of how low the health risk.

The headline says a study found that teen vaping is "linked with toxic lead exposure," but does the article back that up with strong evidence showing causation?

Not at all.

“Uranium specifically has MANY different important SOURCES OF EXPOSURE (including food, water connected to geographic location), which were NOT CONTROLLED FOR in this analysis. Further, PREVIOUS WORK HAS NOT FOUND DIFFERENCES in uranium exposure between non-users and users of e-cigarettes nor detected uranium in e-cigarette aerosol, suggesting THIS FINDING MAY BE EXPLAINED BY OTHER FACTORS.”

"Lead, however, has been detected in e-cigarette aerosol in previous research. Yet the urine LEVELS REPORTED IN THIS STUDY, even in frequent vapers, ARE BELOW OR SIMILAR TO THOSE FOUND IN THE GENERAL POPULATION and in adults who don’t vape."
