It's basically a grandfather clause....Any
tobacco product that was sold prior February 15, 2007 wont be affected by these new rules.
Ecigs hit the US market in 2007 is my understanding.....IDK if they made that "February 15, 2007" magical random number(which might not be so random)
Not sure it matters really cause there is this clause "and has not had any modifications" We Are NOT used the same ecigs today that they where 2007..heck we arnt using the same ecigs from 6 months ago.
So any "new" products the manufacturer is suppose to send in "Substantial Equivalence Report to the FDA by March 22, 2011 for its product to remain on the commercial market while FDA completes its review of the Substantial Equivalence Report."
