this is the case where njoy (and smoking everywhere who dropped out) appealed their orders being seized by the fda. judge Leon ruled the fda could not do that and he will ultimately rule about whether e cigs will be classified as drug delivery devilces or under under the tobacco regulation classification. his comments lead he will go with the later, so it helps the cause to make sure e cigs cannot be banned while they do years of tests to regulate under drug device protocals. other vendors can still have their shipments seized, but if they go to court, chances are they can win their cases.
