Deeming regs raising itself out of the mire

This is not as much time as we might think. All said and done, regulation could easily be pushed through by the end of next year. It might even take another industry shaking set of lawsuits against the FDA to keep it from ruining the industry — like it did in 2008 and 2009 when the FDA banned electronic cigarettes without any real evidence that they deserved it.
The FDA will regulate ...
when they feel they are "bullet proof" from lawsuits.

Yup, I've heard from several sources that the deeming regs were left with the OMB some time shortly prior to the shutdown.

I've read the same thing Smokey Joe :( Although if the OMB comes back to the FDA with changes they "could" have to go through several revisions between the OMB and FDA before being published in the Federal Register so if its true, it doesn't have to mean we will see them soon although I suspect we will.

Wow, according to the 'article', the FDA has the power to levy taxes. I had no idea...

No, the FDA does not have the power to levy taxes.

Yep, we are in for trouble.. This is exactly what I thought they would try to do:

"If passed, the deeming regulation (as last claimed by the FDA) would classify electronic cigarettes as tobacco products. This would place regulatory control of the products in the hands of the FDA as part of its control of all tobacco products. Most likely this would also mean hefty taxes, testing and quality barriers, advertising and flavor bans, restrictions on who can sell them, packaging requirements, internet sales bans, and other elaborately designed obstructions. This would most likely ruin small (well, smaller than huge that is) electronic cigarette businesses and hand the industry almost entirely to the biggest three tobacco companies (Philip Morris, R.J. Reynolds, and Lorillard)."

Well if this comes to pass . i will never give the tobacco companies 1 more cent of my money. I have supported their greed long enough over the yrs. Who knows what kind of garbage they will put in the juice. We can all imagine i'm sure. I finally feel good for the first time in yrs will not go back. I just feel sorry for all the smokers who still have no knowledge of how much better you feel making the switch.well i for 1 know fda has a special place in hell just for them . I just know karma is a WITCH .

One thing I am sure of the current admin will take care of themselves and their buddies first. You are just a blip to be taxed. Common sense does not fall into their realm.
I don't think you should limit that statement to the current administration...
I hope we don't say the same ... about the "next" administration
:p
