Could a FDA stop on a well known smoking alternative create a potential for deadly results for U.S. smokers?

Partial Quote:

There are now reports flying across message and forum boards that a decision is near on the fate of the electronic cigarette. Several of the post concerning the case states that the decision has been made and the paperwork is ready for the announcement of the decision by a top federal judge.

This brings to the forefront a question that few have thought of concerning a potential ban of the e cigarette, and that is a black market for the e cigarette. The word on several e cigarette forums is that the Food an Drug Administration lacks the manpower to police all shipments into the US and that it will still be simple for the users to purchase them directly from China.

I am planning my lawsuits against FDA.

First lawsuit: I could switch back to analogs because they are FDA approved where electronic cigarettes are not. My health problems will return and I will eventually die. If I continued to smoke my doctor told we my COPD was getting worse and I could die from this. But it will be the FDA's fault because anything that is approved or under the control of the should be safe. Quote from Dr Seigel

One of the major criticisms I have leveled against the proposed legislation is that it would give cigarettes an FDA seal of approval, thus undermining the public’s appreciation of the hazards of smoking and providing the tobacco companies with a golden marketing opportunity. The companies could start boasting that their products are officially approved by the U.S. Food and Drug Administration and that they comply with all federal regulations and requirements regarding the safety of tobacco products.
Can you imagine statements on cigarette packages, advertisements, and web sites which state: “Our products are strictly regulated by the United States Food and Drug Administration. The FDA has approved this product for sale in the U.S. It meets all regulatory safety standards promulgated by the FDA.

My seond lawsuit: If they don't allows us to continue using Electronic cigarettes then I will file the class Action Lawsuit:

The FDA, which has no control in China to stop the flow of uninspected units into the country because of a lack of manpower and are potentially opening the special interest groups and the FDA to a landslide of lawsuits for forcing electronic cigarette smokers to use a potential dangerous product and putting their health and others around them at risk.

Anybody want to get on the band wagon.

My son is a lawyer and he will handle this for me which ever way it turns out.

Nice for him to volunteer since civil suits can run on for a long time. Of course, if successful, jury award has the potential of a well earned contingency fee.

I'll still be vaping for a long time after, if they do ban it, and if I fit into a category, I'm in.

As I said before, this may have to be fought under J. B.'s battle plan for ASH.

Just to let you know Tobacco cigarettes are not I repeat are not FDA approved. Here is why you should read the actually bill before thinking that tobacco is approved by the FDA which they are not. The main reason for this bill is to squeeze the cigarette companies. Cigarettes can not be banned because of laws that were written 50 plus years ago.

The laws need to be rewritten for it to change which can take years if not decades. So in the mean time until they can find that loop hole in the law its been place in the FDA's care to help squeeze the throat of the cigarette companies. If you haven't noticed in the bill how its marketing now and adding flavors and other ingredients will be a thing of the past for cigs soon.

Fda is simply regulating how it can be sold, what can be in them... they are not and will never be FDA approved.

I don't see how this excuses them in any way from being held accountable for the unethical and immoral banning a less harmful product and forcing us back to tobacco. They work for us. They are paid by us and their job is to protect us, not to bully us into doing something more harmful so they can collect their illegal 400% unrepresented tax.

Again its the laws that are written that are screwing us. The FDA has the power to say what is a drug. And years before ecigs came into reality nicotine was considered a drug. Back in 2000 the FDA tried to get cigarettes banned because of the nicotine factor. Because of past laws that which protects tobacco nothing could be done. Finally the FDA has gained the power to regulate what can be put into cigarettes and how it is marketed but sadly can not at this moment gain enough power to ban them altogether. It's sad that our own stupidity in this country has cost the lives of millions and whats worse is we haven't learned a damn thing.

I loathe the FDA... All we can hope for at this point is that they will continue spewing out these departments of government until they eventually create one in charge of regulating the departments of government themselves, i.e. the "Federal Department of Departments". Then, just maybe, we'll be getting somewhere.

Even if it was as easy as one person signing a piece of paper in order to ban cigarettes it would never be done.

The country makes way to much money off of them not only from the jobs and money that the tobacco industry provides but also from the taxes, money spent on health care, and money spent on "smoking cessation" products.

Count me in.... those C%#Suc$^$^%^ers got whats come in to them... For what it is worth, the FDA and all the legislators don't have enough money to stop us all!!! I am sure if it comes down to it, any lawyer would enjoy being on the pilot seat for this one and it may take a band of lawyers to equally manage the task. My mom can line up more lawyers if need ... and several that have more than 25 years of experience directly in the feild of specializations that we would need. Just let me know.

VAPERS UNITE!!!!
