Evolve will now have to shell out millions to stay in business in the USA and sell in the US market or move offshore.
Every software version is a new FDA approval process.
Evolv doesn't make finished "tobacco products" requiring approval...

Now that doesn't mean that business won't get more difficult for them, only that these regs don't affect them *directly*.

they still have to be approved since it is a device targeting vaping. And software is specifically mentioned in the Deeming regs as being a vaping product if used in a vaping device.

Without approval they cannot sell their devices directly to end users. Their chips and software will be a tobacco product after August 8.

yeah this is a bummer they should be spending their efforts trying to help modify the fda reg's not fighting people trying to bring us more cost effective equipment, if it is costing them business they should be focused on trying to make the dna chip more cost effective if they win they will have spent plenty on this lawsuit and dna devices sure wont be cheaper if they win. probably will go the other way.

Unless Evolve gets their chips and software FDA approved their patent is moot.
I don't think so. Provided it holds up as legit in the courts, anyone that makes any device using the claims in the patent -- and wants to sell that device in the US -- will have license it.
