FDA to regulate e-cigs as tobacco products

Actual the decision for e-cigs to fall under the FDA's control happened in April 2010 when the courts over ruled the FDA's claim they were drugs delivery devices and fell under the category of tobacco products instead. Sort of a half victory for us as they are not tobacco products either.

But isn't nicotine derived directly from tobacco, or can it be synthetically made? If derived from tobacco only, the FDA ogliarchy can claim it's a tobacco product.

Nicotine is most definitely found in things other than tobacco, like eggplant, under-ripened tomatoes, potato skin, cauliflower...

But can it be synthetically be created from other sources, besides tobacco? Combined with your statement, one could hardly make the argument that nicotine is strictly a tobacco product, right?

It seems quantities are such that nicotine extraction from plants mentioned is not practical due to low levels. There is one plant which is native to Australia that contains higher levels. Whether it might be a source for nicotine is not known by this poster. Duboisia hopwoodii in a particular river region has relatively high levels on nicotine. I don't know how those levels compare with tobacco, but the plant has been used as a chewing tobacco-like substance by indigenous Australians. In other regions, the plant can be poisonous.

Unknown to me as well is whether under 'deeming' protocol, nicotine from other sources could be 'deemed' to be 'same as' tobacco or something like that.

Just noticed this is from 2011 - It was a new article on fark.com. Not sure why it's suddenly showing up there.

Even though that particular article is old, the FDA is trying to ban e-cigarettes completely (making them illegal).

"The FDA has repeatedly stated its intent to propose a “deeming” regulation to apply Chapter IX of the FSPTCA to e-cigarettes. Sections 905 and 910 would ban all e-cigarettes, and other provisions of Chapter IX would also decimate the e-cigarette industry, protect cigarette markets and otherwise threaten public health. The FDA should NOT propose or approve any regulation that would deny cigarette smokers legal or affordable access to less hazardous smokefree alternatives." ~ Bill Godshall

I'm not sure what good the petition will do but it doesn't hurt to sign it and it will only take 5 min out of your day. Those 5 minutes could give e-cigarettes the one extra push they need to stop these regulations which would allow you to continue vaping in peace.

Targacept is a company that is developing a synthetic nicotine for treatment of Alzheimer's, schizophrenia, overactive bladders, and other medical issues. They're trying to achieve a product that provides the benefits of nicotine without the addictive and other undesirable properties. Also Duke University has been doing studies for years concerning the use of nicotine for treatment of Alzheimer's and Parkinson's Diseases. They are currently placing these patients on permanent nicotine patch therapy.

There have been several studies over the last few years pointing to nicotine as being a preventative drug for Alzheimer's. Right now the vast majority of people diagnosed with Alzheimer's are non-smokers. People who have smoked for years generally do not get the disease. If those type studies continue and the use of nicotine can be proven to be beneficial to our health, even if it's a synthetic, then that will be a huge win for us in terms of availability. The only issue at that point would be the cost.

Almost every plant in the solanaceae family contain nicotine. There are a number of plants within this family that contain a high concentration that are not tobacco plants.

there is even a certain type of tree that produces a growth on it,that has an un-godly high nic concentrate to it

i won't tell you which tree it is,but it is just below the northern tree line

Don't believe everything you heard "in another thread." It's not nonsense, and those sections very well could take all currently available e-cigarettes off the market. They mandate pre-market testing which has not been done (nor has it even been defined) for anything you can buy today.

It's also obviously untrue that nobody "is saying that," which is easy enough to verify with a quick Google search.

I say FDA is not going to 'completely ban / make illegal' eCigs.
But, I guess we'll just have to wait and see, eh?

All true. But if you'd claimed that nobody was saying those things, like you are claiming in regards to the potential banning of e-cigarettes, you'd simply be wrong.
