NEW JERSEY: (UPDATE) Governor Murphy announces recommendations of his task force on vaping, which included a ban on both flavors and online sales. Murphy said he doesn’t have the authority to ban flavors products by executive order. Both the task force and the governor blamed flavored retail products for the lung illness outbreak that has been more strongly linked to unrelated products sold on the street. The press conference was a farce that included such doozies as "There is no scientific evidence to date that identifies e-cigarettes as a smoking cessation product." and "Fifty percent of people who use nicotine or tobacco products will die from it."

OREGON: (UPDATE) Governor Brown orders 180-day ban on flavored vaping products, following other governors in falsely blaming nicotine vapor products (sold to help adults quit smoking) for the recent outbreak of lung illnesses. While the products most often linked to the illnesses are also flavored, the reason people use them is because they contain THC, the chemical found in cannabis that creates the "high."

WASHINGTON: (UPDATE) State bans e-cig flavors apparently to stop "epidemic" of record DECLINE in youth smoking? Grade 12 smoking rates were flat, dropping only 3.1 percentage points from 2002-10. As vaping rose from 2010-18, grade 12 smoking rates dropped a WHOPPING 11.6 percentage points! Young adult (18-24 yrs) smoking is also now at a RECORD LOW, so that contradicts the "gateway" theory of teens who vape moving on to smoking as young adults.

SAN DIEGO: (UPDATE) All lawmakers considering e-cigarette bans should be made to listen to San Diego Supervisor Kristin Gaspar, who stated that banning retail products that help adults quit smoking “misses the mark in favor of political grandstanding.”

Her compelling speech also included other statements that hit the mark:

"We must separate fact from fiction to understand any crisis. It's important. Far too often, government attempts to solve a crisis with well-intended, knee-jerk policies that end in absolute failure."

"Strategies matter! And make no mistake, feel-good policy will not protect our kids - my kids."

"We need to learn from [kids]. we need to listen to to them. We don't get to decide...how things are done, how things are purchased."

"Snapchat. The internet. Instagram. It's a common thread. Snapchat. Snapchat users, not storefront owners, are marketing to our kids."

"Selling products to these kids is illegal and it's wrong, but while the target of this item is clearly the kids, the actual target today is the law-abiding adults!"

"I asked for the violations. I asked for the number of times these storefront owners have been cited for selling to minors and guess what? I have nothing in front of me. But yet, you're passing legislation today that goes after those storefront owners, telling them that they're 'bad actors' and you have ZERO in the way of evidence and that is wrong."

Unfortunately, the measure still passed 3-2 (with Supervisor Jim Desmond also voting against.) Ironically, Supervisor Greg Cox said he agreed with Gaspar and Desmond's comments but supported the ban because the public health crisis "required action." Clearly, he wasn't really listening.

NATIONAL: (CALL TO ACTION!) Fight to Keep Vape Mail Legal! Tell your lawmakers to reject S.1253. This bill would prohibit the U.S. Postal Service from accepting packages of vapor products for delivery and raise the cost of purchasing vapor products by $15-$20 per shipment for millions of adults who don't have access to vape shops!

Online bans may seem "reasonable" to reduce teen purchases, but only 5.7% teens surveyed vaped daily. Meaning most teens didn't actually purchase products, but instead just tried a friend's. And smoking rates are highest in poor/rural areas - where cigarettes are plentiful, but vape shops are rare!

BREAKING NEWS: (OREGON) A month ago, a state Court of Appeals temporarily halted the governor's flavor ban, finding that the state most likely did not have the standing to ban flavored nicotine vape products. It now has extended that stay.

"No evidence has been presented connecting flavored vape products to lung injuries."
