BREAKING NEWS: The US Court of Appeals for the Fifth Circuit majority ruled the FDA acted "arbitrarily and capriciously," sending manufacturers "on a wild goose chase,” telling them what would be needed for approval and then denying all applications.

"...

First, the agency gave manufacturers detailed instructions for what information federal regulators needed to approve e-cigarette products. Just as importantly, FDA gave manufacturers specific instructions on what regulators did not need. The agency said manufacturers’ marketing plans would be “critical” to the success of their applications. And the agency promulgated hundreds of pages of guidance documents, hosted public meetings, and posted formal presentations to its website—all with the (false) promise that a flavored-product manufacturer could, at least in theory, satisfy FDA’s instructions. The regulated manufacturers dutifully spent untold millions conforming their behavior and their applications to FDA’s say-so. Then, months after receiving hundreds of thousands of applications predicated on its instructions, FDA turned around, pretended it never gave anyone any instructions about anything, imposed new testing requirements without any notice, and denied allone million flavored e-cigarette

applications for failing to predict the agency’s volte face. Worse, after telling manufacturers that their marketing plans were “critical” to their applications, FDA candidly admitted that it did not read a single word of the one million plans. Then FDA denied that its voluminous guidance documents and years-long instructional processes meant anything. Why? Because, the agency said, it always reserved the implied power to ignore every instruction it ever gave and to require the very studies it said could be omitted, along with the secret power to not even read the marketing plans it previously said were “critical.” It was the regulatory equivalent of Romeo sending Mercutio on a wild goose chase—and then admitting there never was a goose while denying he even suggested the chase. Cf.William Shakespeare, Romeo and Juliet act 2, sc. 4.

“Do we stand on a self-proclaimed moral high ground and undermine the tools that can help or do we genuinely commit to saving and enhancing lives? We practice harm reduction with methadone, seatbelts, helmets, speed limits, condoms, alcohol - why should tobacco be any different?”

1) Vaping is less harmful because it eliminates where 99.9% of the harm comes from: SMOKE.

2) They exposed MICE to three 9-MINUTE puff sessions!

3) Real world HUMANS have been #vaping nicotine salts for years without increased reports of arrhythmias.

It's no surprise there would be more "underage" sales when you suddenly make thousands of adults "underage."

The rest of the article is typical alarmism -- including the "gateway" claim despite the fact that frequent WI teen smoking is DOWN to 1.8%.

The article source is from this infographic, which also claims 10.5% vaping (2022) means "nearly a decade of lost progress" compared to 10.7% smoking (2014.) But smoking is down 8.9 percentage points since 2014 while vaping is up only 2.6 points, meaning there was PROGRESS of 6.3 points over that period! Their own chart shows vaping dropped by nearly 50% since 2018!

Vaping liquid company wins 2nd chance in court & FDA gets scathing opinion. Columbus flavor ban kicks in, OH lawmakers attempt to stop such bans/taxes. OR court blocks Multnomah County flavor ban. Glanz is up to his usual trickery and more!

A new anti-vaping campaign reportedly will tell youth that vaping "can mutate DNA and cause cancer," even though there is no scientific evidence that vaping actually causes cancer.

The unspoken yet deadly message here?

"You may as well keep smoking."

This makes us wonder how many people gave up on trying to quit smoking because they've been lied to for decades that nicotine is "as addictive as ....... or ......, maybe more."
Oh, I cringe every time I hear "quitting smoking is harder than quitting H". But I cringe harder when I hear people, especially vapers, parrot it. Anyone who has any experience with that knows it's total BS. But parrots be parrots and the world is 80% parrots, which is how they get away with spreading these lies...they have tons of ignorant minions at their disposal.

I'm convinced these lies are started to keep a certain percentage of smokers from quitting to keep the market profitable.

This article by the University of Texas MD Anderson Cancer Center starts out relatively balanced as far as most "But We Don't Know" vaping articles go, then quickly deteriorates into dangerous misinformation about EVALI, popcorn lung and "gateway to smoking." Incredibly deceiving was the implication that combustible cigarettes are somehow better "regulated" by FDA when most brands were grandfathered out of the PMTA requirements.‍♂️

Wisconsin vapers should pay attention to "health officials raising concern" (ie. whipping up hysteria) about #vaping by misrepresenting facts.

Youth smoking in Wisconsin is at "all-time low,” vaping is down nearly 50% since 2018 and “overall tobacco use is down,” so clearly these underage sales stats do NOT reflect youth USE.

These so-called “PMTA Registry Bills” are currently making their way around the U.S. They make it far more difficult for companies awaiting PMTA to sell life-saving products and ban thousands of products popular with adults.

The Supreme Court has declined to hear a case challenging California’s voter-approved tobacco/vape flavor ban. After losing in the district court and an appeal rejected by the Ninth Circuit, this inaction ends Reynolds’ hopes of reversing those decisions.

Without citing any evidence, Dr. Thau of Hartford HealthCare in Connecticut ridiculously claims “vaping is similar to inhaling an acetylene welding torch," then he misleads readers by conflating lung injuries from vitamin E acetate in illicit THC vapes with nicotine vapes.

Flavor bans are often based on "hypothetical ban" surveys showing positive results, but this survey comparing hypothetical bans to real bans shows those aren't translating into real world results. Exclusive vapers were over 2x more likely to switch to smoking than quit everything - the exact opposite of the intended effect of banning flavors!
