Help/info request RE: CBSA and seized shipment.

Finally got mail today, telling me that 'a shipment' was held, inspected, and 'recommended for refusal'

The order I am talking about was 'seized' on the 12th of jan(was shipped on the 10th) and JUST today I got a notification that my order was 'stopped' with the above message (Claim reason was because it was a prescription drug???? ... c.01.045 food and drug regulations act)

Thing is, the shipment had 6 cartridges, empty, as well as a 1.8% 50ml bottle of e-juice. In the letter the juice is mentioned but the rest of the shipment is NOT.

What do I do here? Seems the cartridges were 'lost' somewhere, and the only contact I have is a number which instantly goes to a 'answering helpline' with no actual contact to any human.

After all research I've done, there is no legal grounds for this 'seize' (Its not a medical product nor a prescription drug, and even if this were so, its not 4+Mg per dose.

Anyone else have had similar situation with Canada customs and knows (or has a better idea) of what to do?

Have you read your countries Customs laws? Seems they consider nicotine a prescription only item. I don't know the laws of your customs so I can't say. But if I were you I'd reasearch those laws very carefully and see if they have grounds to destroy the shipment. If they don't , I would try To contact them by any means Possible. Leave a message if you don't get a person and do your best to fight this. But be very familiar with the laws and quote them whenever possible. Best of luck.

Not much you can do. CBSA will send the package back to the originator because it had e-liquid with nicotine. While there is some question as to whether Health Canada can require CBSA to block shipments with e-juice, the fact remains that they can and do reject shipments when caught.

Your best bet is to find Canadian companies to order from.

I attended university in Montreal (McGill) and I met my wife there. All of her family lives in, and around, Montreal. Most of her family (dad, mom and everybody else in that generation) have already killed themselves off by way of inhaled tobacco products (mostly lung cancer, but several instances of terminal COPD, as well). I have a brother in law and a sister in law, who smoke, big time. Also, their significant others also smoke, and I think my 17 yr old niece has recently taken it up as well. My wife is concerned, and has urged me to getting them on vapor. We go up there a couple times a year, and were planning a trip up in June, after the weather breaks :) I was planning to bring up some vaping supplies (e.g., 5 EVOD clones, some menthol crystals and other flavorings, and a few hundred mls of stock 48mg/ml juice). I've been traveling back and forth between the US and Canada so much over the past 40 years, I sometimes forget that it is another country, even if I do have to show a passport. Until I read your post, I never even thought about Canadian customs. Now, I'm starting to wonder if I should pre-mail the unfilled EVODs and flavorings up there, and bring the juice in my carry-on in a few cleaned 60ml hand sanitizer bottles :D Seriously, is there a problem hand-carying e-juice into Canada?

by all the laws i've read about it, theres nothing actually illegal about e juice or ecigs. The law is quite clear about it actually, and the letter they sent has a law/act listed which if read (Had to look it up, not that they would print it there on the paper lol) that goes out of its way to EXCLUDE ecigs (IE: in a form to be administered orally by means of an inhalation device delivering 4 mg or less of nicotine per dosage unit, and unless you actually DRINK 1/3rd a 100ml bottle of 2.4% liquid will you get anywhere even close to 4mg)

It also states, quite clearly, that its NOT 'a prescription drug' in the above example(IE anything 'but' or anything 'more' than the above = prescription)

The other issue is the REST of the shipment. The letter they sent me has the bottle of 1.8% juice(50ml) listed, but NOT the cartimizers (which were the real reason I made the order, stupid v2cig pro3 device needs its own cartimizers, honestly fail on my part thinking this would be the wise way to go, if I could rewind time and go with a different method I would)

Now I would like to know what my options are, as in I can easily get ejuice from shops here in town(theres quite a few of them really) but the cartimizers are the real issue. I asked here hoping someone had had something similar happen, and want to know, whats going on with the REST of the shipment, the stuff which they have no reason nor right to take. (And why was it omitted from the 'shipment' on the letter?)

be careful with your math.... 2.4% = 24mg/ml so 1/6 of a ml has 4 mg 30ml has 720mg in it

Your options are pretty limited. Contact the company, explain what happened, and when it's shipped back to them, have them reship to you without the e-liquid.

Well talked to the lady from health Canada, and even though I pointed out how HC's own laws and regulations specifically exclude ecigs from the 'banned schedule F list' (Pharma drugs) she kept repeating no more than 'its because its ecig' (As in it don't matter what laws are what, its just e-cigs and that's that, theres nothing else to it regardless of what laws are out there.)

Also, and the most scary thing she said, at least I think, was when I asked if it was because of the fear of losing revenue from taxes from tobacco sales they were 'cracking down' on ecigs, she said 'I will not confirm or deny that!' (Don't politicians say this when they are caught doing something illegal? LOL)

Also she said that 'only items caught by us get sent back' and 'there was nothing else in the package' (Which is a lie, someone pulled the carts from the package and pocketed them or 'lost' them)

When she said "items caught by us" she meant packages as a whole. They don't pick things out and then let the rest of the shipment go on. They'll reject the entire shipment and send it back to the originator.

Again, contact the originator, explain what has happened, and have them reship without the e-liquid when they get it back.
