Help! My overseas order 'under FDA review'. What are my rights?

Ooooh, I was under the impression some people were purchasing directly from China... Whenever I ordered my stuff, they were being shipped from WITHIN the United States due to the vendor already having the product I guess is a better way of putting it. :)

Well, even though most of us consumers buy from US-based retailers, it is still our concern. Whenever a supplier loses money because of FDA's nonsensical actions, the supplier must pass along the loss to consumers in the form of higher prices.

The only problem I see with placing a lot of smaller orders is the high shipping charges. It is not worth the low price if shipping bumps your cost up so high you might as well order from a local source. I have placed a few bulk orders with no hassles, but it seems it's the luck of the draw. Most of my orders might be considered "small" compared to big vendors etc... I hope you get your order, as this could happen to any of us trying to save a few $ by ordering bulk from over seas. I really wish this whole e cig ban thing would not be an issue, it is crazy to think we can't decide for ourselves what we want to do to our own bodies, considering all the multitudes of other unhealthy choices we make or are exposed to every day. Where vendors are concerned? Nah, i doubt many of them are hurt financially when a shipment is stopped. They just send it back, and have it either resent in smaller packages, or get a refund (credit).

They probably only lose a potential sale IF they let their stocks run too low. Of course, they know about this thing with the FDA. If they wait till last minute, its their fault. They know there might be a problem.

I know the volcano reps said there parts get held up in customs...on the island for weeks sometimes before they are allowed to get their stuff...it does affect stock levels as our economy is mostly "on demand" or pretty damn close ...when part of the chain gets messed up it does have consequences...

Of course China-US trade relations are not that great right now so that may have something to do with it...and so could the FDA being ....

Is a can of soda a "medical device?" Screw the government and FDA, and screw their stupid re-defining of everything so they can impose their will on us more and more, as well as keep us blind to REAL health information so we take their stupid friggin' drugs...

I had a small ?? ($600.00) order seized by the FDA. After many calls, to many dead ends for several weeks, here is basically the final answer I got from the FDA Ombudsman.

Dear Mr.****:

Our office can not assist with refused entries unless FDA has made an irrefutable error. Further, our office would not be able to assist in the matter you wrote about; please see the attached information that was recently posted on FDA's website. You can call FDA's Center for Drug Evaluation and Research (CDER) if you have more questions at (301) 796-3110.

I was SOL. I could gamble, send it back and pay shipping twice/ three times, and hope it made it through the second time or give it up to the FDA to "destroy"..?? I did not take the gamble. :(

The proforma/ BOL was labeled "electronic parts".

I hope your saga ends with better results.

Oh, and if I was a plaintiff in the Njoye vs FDA lawsuit they would have let it through.

Yes, big government at work "protecting" us. We need to vote the big brother liberal so & so's out in the upcoming elections.

I knew a woman that did surveys for the good ole FDA. She worked for a private medical quetionare company that data-logged a product for the FDA to put their rubber stamp on.
She said, She contacted people in other country's in group studies to see how many people died or got sick etc from a tested product to be ok'd by the FDA. Well she said,"If the case study for instance had a 20% only death rate per 300 people tested, then that drug would get the FDA rubber stamp approval!" Nice to know the FDA is just a rubber stamp government organization of super highly paid rubber stampers, and the people actually doing the research...are the dead ones!

BTW... I just noticed..I'll be passing through this week and stopping for lunch at the Kumm Esse on Cr. Of 501 & 422.
Right in front of the huge water tank!.. Love the town, and the people!

Holy crap, I had to re-read that to make sure I read it right the first time... You just mentioned the Kumm Esse. I'm like 3 or 4 blocks from that place, but oddly enough, I've only eaten there once in my entire life, and I'm 24.

That whole rubber stamping thing and the fact that 40 out of 200 people can die, and the stuff is still approved doesn't surprise me at all. In a way, the auto industry and others work in a similar manner. Anybody remember the Ford Pinto? If a defect is found, they look at the rate of failure and the likelihood of getting sued, and all the money that would be required to settle lawsuits. If that amount of money is LESS than the cost of a recall, they don't recall the product. They just say "screw it, let 'em die, we'll pay the money if we have to." As far as I'm aware, the Ford Pinto was never recalled, despite blowing up the gas tank when rear-ended. Then earlier this year, or was it last year already? I can't remember, but all over the media, people were bashing the living crap out of Toyota for having a defect that caused them to recall their vehicles. The recall shows me that they at least give a damn, but the media was basically saying "lolz, Toyota doesn't know how to make cars!!!" Don't get me wrong here. It came to no surprise that the media did this. It just pisses me off to no end because they do this with everything. They try to scare the living .... out of you every time a new virus is discovered and they make everything seem unsafe.

The word on the street is Philip Morris and RJ Reynolds have E-cigarette prototypes in the works. Obviously, Big Tobacco wants a piece of the action. So if Big Tobacco gets into the E-cigarette business then, of course, the FDA will immediately approve "Big Tobacco's" E-cigarettes as safe.

The FDA hasn't been making noise lately about E-cigarettes and the reason might be they don't want to be slamming a product that they will soon approve as safe. Well, of course, safe would only apply to Big Tobacco's E-cigarettes.
