Is it legal to export electronic cigarettes from the USA?

I'm wondering if it is legal to export electronic cigarettes from the USA so long as it is to a country where they are legal.

Might there be customs issues on the USA side?

And if so, can we actually claim this as 'Electronic cigarettes' without fear of seizure?

Well, from what I understand there is even a Customs clearance for exporting goods. I'm not sure how strict they are on oversight, though.

Wow, I expected a bit more response than this. Anyone have any idea what the stance is on exporting these goods under the "De facto ban?"

They're going to a country where they are in fact legal, and they are not being sold to anyone there so there is no point of sale here in the USA.

They are very strict on the dollar amounts with large penalties for lying on the export declaration.

That said, why do you thing this a customs issue? There are a few states that have made e-cig sales illegal but not the federal government.

The dollar amounts don't really apply as I am not selling it, I am giving it away to the UK Vapor Station chapter.

The FDA has placed an import ban on electronic cigarettes. I am only wondering if there is a risk of seizure in the export of electronic cigarettes as well.

You're exporting not importing. Different list.

There are items that can't be exported, usually very high tech or defense oriented and some specific items to some foreign countries. As example, almost nothing can go to Iran or Cuba.

If this is going to keep you up at night, hire an import/export agent. They will know the law and if you have to lie, they will do it better and safer than you or I could.

I am also very interested in this topic. No real answers so far. Has anyone had any of their ecigs or liquids seized by customs? Be nice to know. I am in Canada and can't find any US companies that ship here. Could this be why?

No, with Canada it is generally an issue with your side of the border.

Like Kona posted, there are items that cant be exported, but the bigger issue in regards to ecigs is the customs agency in the country shipped to.

Thanks for the responses. Nice to know. I don't have much experience with things shipped from other countries. I haven't even tried an ecig yet. Waiting on my order with baited breath. Can't wait. It's coming from China. Hope it won't be seized.
