Is it legal to sell e liquid with no license or anything like that or do you need one similar to when a store wants to sell tobacco products?

I am in no way interested in selling anything or starting a business. I simply want to know if this stuff is, as far as the law is concerned comparable to tobacco. Again, this is for information only as I haven't found it through my Google searches.

Haha of course some of those things are technicalities I guess if I was to put my question into a real life example it would be...

Would Walmart need anything to be able to sell e-liquid? Or is there just an age restriction on the product?

You did shed some light on the matter though, so I take it that if it has nic in it it is not for minors? Of course I KNOW it's poison and not good for children but didn't know if there was a law specifically for it.

Utah - has banned ecigs for young people, prisoners and people in facilities for 'help' with mental health problems.

lol that is a funny state law.. But it sounds like with the first link that there is no law stating you need a permit or anything in my state at least which is IA.

The second link is a law regarding Massachusetts I assume? That would mean each state is governing them differently?

BTW Thanks a ton for finding all this lol, I swear I didn't find anything remotely close to useful when I was looking this morning.

Pretty sure that it safe to say that if an established retail chain wanted to sell e-liquid they could do so very easily nationwide if they already sell tobacco products. There might be some local regulations they would have to comply with- pretty much the same deal as they have to comply with "blue laws" and "dry counties" for alcohol sales.

I wished that one of the huge retail chains would start to sell different vendors e-liquids, I think it would help the industry a lot and make e-cigs really churn and get out there, in fact I'm surprised that a few of the bigger vendors haven't approached this idea, if I had a juice company I know I would be.

My local WalMart does sell ecigs, unfortunately it is limited to the little itty bitty ones that look like cigarettes.

I agree that it would be really nice to at least have some juice around me hah. I already let myself run COMPLETELY dry before I order more... don't ask it is a problem.

One thing I find curious is most states require a license (completely different state to state from what I understand) to sell smoking cessation products. This should cover the patch, gum, etc. Logically it kinda makes sense if states treat the ecig as the same thing... at least at first. While it has potential to be used without any nicotine, this probably isn't the case for a majority rule.

Also, I dunno why I said Walmart... of course they sell cigs haha. I dunno why I even said that yesterday, let's just pretend I said Barnes and Noble or something :p which would be kinda cool. They would set the standard for vape reading.

They are not "smoking cessation aids" (and we don't want them to be marketed as such either btw) .

They are simply a safer way to obtain nicotine compared to smoking or using tobacco. Elimination of carbon monoxide, smoke, and thousands of chemicals (many which no doubt are highly addictive and deadly) . This distinction is what caused the FDA to "back off" (with the help of Federal Courts decisions) .

Yep, it's going to get regulated to death.

Currently we have what's known as a "free market". Vendors prosper or fail according to the guality and value of products and service. Government has little involvement and does not pick the winners and losers-- we do that.
