Nicotine is not a scheduled drug. Nicotine itself is not "approved", nor does it need to be. Items that provide nicotine as an aid to stop smoking are considered medical devices and do need to be approved as such. And any new drug that contains nicotine as part of a compound would need to go through an NDA.

To further complicate matters, the FDA now has some oversight on tobacco products.
