Go to your normal branch and calmly explain your situation. Be respectful but firm that it was the shady merchant's fault.
As a banker, we see this kind of thing all the time, and when it's a legitimate merchant mistake/scam, charges are generally reversed.
Again, if you go on the offensive, you won't make an ally out of your banker, and they are not required to return the charges until all other avenues are exhausted, including telling you to pursue the merchant.
The fact that you don't routinely overdraft, and that the charge was reversed is good evidence on your side. Give it a shot, you may be surprised.

Yes, it is smokingeverywhere. Have contacted Florida Attoney Generals office. That's a joke also. Considering legal action now. Have to file a dispute with my credit card company to remove the charge. I have returned the shipment to them so now they have merchandise and my money. Class action suit would be perfect.
Hmmmmmmm, I placed an order with them yesterday, and then I found out they would not send me the product for 6 weeks, so I called them to cancel, no problem, and my refund was placed back on my card within hours.

You'all might want to try calling them back again. I'm thinking maybe they got there act together concerning canceling orders!?!?

All I know is, I need some luck in trying to cancel my current order with a different company. Their starter kit was really cheap, but then I found out it dosen't come with cartridges, so it turns out to be twice as much as the others.

I'm new to this whole thing, i. e., computers, online orders, online debit/credit card card ordering, and now e-cigs. It all proves out to be a real pain at times.

So you are correct, the whole fricken thing is a scam if ya ask me!!!

I am on good terms with my bank. They no whats going on but of course its the waiting game as we watch for the refunds. My bank card was even reported for unauthorized use and canceled. I never received anything from SE!! Never!!!!
I never had an account number either.
But my bank thus far has been on my side. I would imagine when the wait is over, they will take care of the fees.
I know they have to be sure it wasnt my fault and now that the credits have come through I think the proof is there!
Tomorrow I am calling to see if they will finish this and remove the charges and get my bank card replaced!
Dam I am lost without it.
I dont carry cash and my bank is over 35 miles away!!
Our car doesn't even go thats far anymore. (Down side to living rural and far from things)

I was a beotch from hell with SE because I found out I am not the only person they scammed.

I also got taken by this company. Cancelled my 'free' trial the same day, took two weeks to gey my 10 bux back, then they ship it to me anyway and take out 99.00 from my bank account! Sent it back, talked to them repeatly, they offerd a 40% discount if I would keep it, ha! So I've tracked the package, they got it yesterday. My refund better be ther by Friday or else...

Then you bounce!!!
Call your bank after you cancel your order and tell them about this company and your fears. If you used a debit card they may be able to stop it. But it has to be done before they hit your account!

OK, will do, thank you! I already sent my Bank an e-mail, and I called customer service, but I need to go to my branch in person in the morning.

What a pain in the a**! I hope it's all worth it. Most of all, I think I'm learning. It's a sad thing being so old school and having to learn all this new (to me) electronic mumbo jumbo!?!?8-o

Hey everyone, another heads up concerning "Smoking Everywhere". They hit my debit card again last night for another $9.95, shipping for their 'free trial'. I guess they are re-processing my order???

So I called my Bank this morning and canceled my debit card, and had them issue me another/new card. So now I have to wait for my new bank card before I can order a different starter kit from a different company.

I'm wondering if I will ever get to try an e-cig!?!? I want one now, not a month or two from now!

What a hassle!!!

Such is life eh!

I am so glad i have a clean history with them (I dont bounce my account ever)!!!

So just that last 49 bucks from SE needs to be credited and I will be back where I started with no financial loss for me!!!!

Of course SE is dragging .... on that last 49. They give the 99 and the 9 bucks but play with that 49!!!:mad:
But I will prevail!!!!!:evil:

I ordered the free trial from them as well. I received the e-cig, but then I found this forum and learned that there were better/ cheaper models out there. Sooooo, after using up all the SE cartridges :)evil:) I sent the product back. I had learned alot about the company from this forum sooo I put insurance and delivery receipt on it. After about two weeks after I sent it back, they charged me $99.02.

I called them up to find out what the deal was and they "searched" their database for the return and came up with nothing. I gave them the USPS tracking number and they saw that the post office had delivered it to them. The customer service rep said that's all he needed to see and refunded my money. It took 2 days for the refund to show up on my account but everything is settled with them at this point.

So yes this company is shady, if you're not on top of them you're going to get ripped off, but if you press them and do everything by the letter you'll get your money back. I'm sure they make a lot of money off of people who just say "Screw it, it's not worth the hassle."

Smoke Assist is not a company to be trusted. They have no problem printing the return policy on every packing slip but if you try to return the product they will not stand by the policy. The Smoke Assist E-cigarette is a good idea however it tastes like a wet cigarette with a hint of carmel candy. If you do not cancel within 14 days of THE DAY YOU MADE THE ORDER you cannot get a refund. If just so happens that I got my e-cigarette and the first shipment of refills in the same week (about a month after I ordered the product). After several calls I was told that I am "stuck" with everything that was sent and out $140.00 fir the "free" cigarette and 1 order of refills. I unfortunately used a debit card and cannot go to my credit card company for a refund. In closing if you don't mind doing business with a company that is not honest and you don't mind wet tasting cigarette then Smoke Assist is for you. Also please note that this company has several names and sells the same product.

Well, I have posted before about my dealings with Smoke Everywhere. I ordered Dec. 6, then found these forum and sent them an e-mail on Dec. 8 asking them to cancel my order. Sure enough, their "risk free trial" pack arrived Dec. 14. I wrote "REFUSED" on the envelope and had it returned to them. Well, they now have debited my bank acct for $89.95. (Interestingly, their company name was Smoke Everywhere when they took the s/h from my acct....now they are Smoke51 when they took my $89.95!) I promptly called them and let them know what I had done up until now. They claim to not have gotten the e-mail (of course) and they have yet to get their trial package back. I talked with my bank, but they can't do anything just yet because with Christmas mail, they may, legitimately, NOT have gotten their package back yet. I plan to call them again and again until I get my money back...or the bank refunds me.
I did try a stop payment, but you have to name the company and the amount they may try to take. Since they came in the first time as SE, then actually got the money under Smoke51, my stop payment didn't work....sigh.

I managed to get my money back... What I had to do was goto the Better Business Bureau and file a complaint. Here is the information you will need to recover you money.

Smoke Assist uses mis-leading tactics and has a "100% Guarantee" that they do not stand by. The return policy states that I have 14 days to get a RMA number and another 10 days to send it back. The item in question is dated 12-10-2009, the postage date is 12-16-2009. I received the package on 12-20-2003. Today (12-23-2009) I called the customer support center twice and read the "Guarantee" to the support person and they explained that the 14 days was when I originally ordered the product on 11-10-2009. This is an entirely different purchase from the original purchase on the 11-10-2009. I was originally told that when I needed refills that all I needed to do was call and order them. This was not the case.

I thank my lucky stars for you guys and your info - which saved me from buying off these guys too.
Saw the mall-stall - got interested (tho the TH off the one I was given to try made me cough n splutter for about 5 mins LOL) and ALMOST bought one; I've never thought about giving up smoking before this, but I was impressed with the idea and it became a possible REAL alternative to slowly killing myself, anyway I decided to check them out first, from the safety of my PC, by searching the brand. . One of the hits brought me here.
My bank account thanks you :)
