Tonight, December 15, 2014, your City Council is proposing an ordinance banning e-cigarette use OUTDOORS and also asking that it be immediately adopted.

Proposed Ordinance addresses:

1.Changes to the outdoor smoking restriction:

- Increase the area covered to include “Regional/Commercial” areas (e.g.: Stanford Shopping Center);
- increase the area covered to include “Neighborhood Commercial” areas (e.g.: Alma Plaza);
- increase coverage to include all outdoor eating areas, public events, work sites and service areas(i.e. locations);
- include penalty escalation for repeat offenders;
- include e-cigarettes;and
- require cigarette .... receptacles and signage immediately adjacent and within areas covered by the ban.

2.That the indoor smoking restrictions and restrictions on sale of tobacco products and e-cigarettes:

- include e-cigarettes in current indoor restrictions;
- ban the sale of tobacco products and e-cigarettes at pharmacies.

Ordinance amending the Health Code by adding density, proximity, and sales establishment limitations on the granting of new tobacco sales permits, and renumbering all sections in Article 19H; amending the Business and Tax Regulations Code by increasing the annual license and application fees; and making environmental findings. First reading was on December 9, 2014. Second reading Tuesday, 12-16-14 at 2:00 p.m.PST.

Additional Information:

No permit shall be issued if:
• the Applicant will be within 500 feet of the nearest point of the property line of a school;
• the Applicant will be located within 500 feet of the nearest point of the property line of an existing Establishment;
• any Applicant whose main purpose is offering food or alcoholic beverages for sale for consumption on the premises, including Bars and restaurants; and
• no new permit shall be issued to any Applicant for operation of a Tobacco Shop.

"Tobacco products" amended to include electronic cigarettes.

[edited to add: This would have the effect or prohibiting any new brick and mortar shops since a "tobacco shop" is defined as "a retailer whose principal business is selling tobacco products, tobacco paraphernalia, or both . . . ." and e-cigarettes would be defined as "tobacco products."}

Ordinance first introduced 12-2-14 that would amend Shasta County Code Chapter 8.45, Smoking in Workplaces and Enclosed Places, to: .(1) .Restrict the use of electronic smoking devices in County buildings and vehicles, enclosed public places, stadiums, and enclosed places of employment; and (2) .prohibit the sale of electronic smoking devices in vending machines

Second reading scheduled for Tuesday, December 16th, 2014 at 9:00 am PST.

TO ADDRESS THE BOARD: Members of the public may directly address the Board of Supervisors on any agenda item before or during the Board’s consideration of the item. In addition, the Board of Supervisors provides the members of the public with a Public Comment-Open Time period, where the public may address the Board on any matter not listed on the agenda that is within the subject matter jurisdiction of the Board of Supervisors. Pursuant to the Brown Act (Govt. Code section 54950, et seq.), Board action or discussion cannot be taken on non-agenda matters, but the Board may briefly respond to statements or questions and, if deemed necessary, refer the subject matter to the appropriate department for follow-up and/or to schedule the matter on a subsequent Board Agenda.

Study Session Tuesday, 12-16-14 at 3:00 p.m. PST for staff to present an overview of the proposed changes to the City's smoking regulations.

Background: In 2013, the Council established goals and strategic objectives for 2013 to 2015. Council Goal 6 states that the Council will “commit to making Santa Rosa a healthy community where people feel safe to live, work, and play.” Strategic Objective #2 is to expand the City’s smoking ordinance for public/private places.

On August 26, 2014, the Council directed staff to update the City’s smoking regulations. The purpose of the study session is to present an overview of the proposed changes to Chapter 9-20 of the City Code and to the Zoning Code and how the revised regulations were developed.
