Medical Field Employees.. Allowed to Vape?

I'm struggling with this issue at my work. I am an office manager for a Home Health Care Agency in Tucson, Az and the boss wont allow us to vape in the office. We don't get breaks and lunches, we are a small/medium sized business with a very small staff and the owner wont allow us to vape in the office. All of our clients are out in the field so the only time we do it is when no one is around which is 3/4 of the time. She says she doesn't like the conditation is brings (I geuss she meant how similar it is to real cigarettes.)
I'm lost at what to do. Any feedback would be greatly appreciated.

Methinks an anonymous call to the state labor commission is in order. I think breaks and lunches are a requirement if a shift is x many hours.

And stealth vaping is in order. In the bathroom if nothing else.

Unfortunately, when you live in AZ, breaks aren't mandated by law. Employers don't even have to give you a lunch if they see fit. It's also a right to work state meaning no unions, no support.

Not that I am a lawyer or anything but I am fairly sure that is a federal law. anyway I am also in a right to work state and we have unions. But do not feel you have to fight the fight unless you want to. Bathroom breaks work for me.

I see that I was laboring (pun intended) under a mistaken impression. I've never worked anywhere that you didn't get breaks and/or meal times, and I thought there was a law that required them.

Right to work does not preclude unions, as Nebraska also is a right-to-work state. It only prevents closed shop situations. In other words, you don't have to pay dues to a union just because you are working in a shop that has a union, and you cannot be denied employment in a shop because you aren't a union member.

Just tell your boss that your doctor told you to drink more water, and keep a bottle of water handy. The by-product of drinking more water, is, of course, the need to use the facilities. Often.

Have you tried to supply your boss with documentation that will reinforce that vaping is NOT smoking? CASAA's website has lots of great info.

Before you started vaping, did you take smoke breaks? I was so excited when I started vaping, thinking I'd never have to go outside when it's below zero outside. Then I discovered that I work in a town that has banned e-cigs, so I stealth vape at my desk, or in the bathroom. Some juices, regardless of what people say about no odor, do have a distinct smell, so I try to vape light juice that doesn't linger. So Atomic Cinnicide is out, Backwoods Brew Cherry is in.
